Where a notification of a dispute is made to the other party to this Agreement both parties will act, in good faith, to resolve the dispute. 7. If after attempting to resolve the dispute, and in any instance not before the elapse of 60 days after notification, the parties are not reconciled, both parties agree to subordinate themselves to a mediation process as articulated in the Code, in accordance with section 43(3) of the Code. 8. (tick if it applies) Any disputes arising under or in any way resulting from this Agreement which cannot be resolved in mediation under clause17(7) shall be referred to arbitration conducted in accordance with section 46 of the Code. 9. The costs of a mediation and/or arbitration will be borne by each party equally, unless otherwise agreed. If a party seeks legal representation in the mediation/arbitration process, such legal costs will be borne by that party. 10. Nothing in this dispute resolution procedure will prevent a party seeking an injunction. 18.
