Competitive Access a. If the airport owner or operator of a medium or large hub airport (as defined in section 47102 of title 49, U.S.C.) has been unable to accommodate one or more requests by an air carrier for access to gates or other facilities at that airport in order to allow the air carrier to provide service to the airport or to expand service at the airport, the airport owner or operator shall transmit a report to the Secretary that-

Competitive Access. During the Term of this Agreement, USS/KOBE shall not take any action which would in any way, either directly or indirectly, encourage any non-Transtar rail carrier to attempt to obtain access to the USS/KOBE Works or which would in any way assist and/or support any such rail carrier in any efforts to obtain such access, provided however, that after January 1, 2007, USS/KOBE is permitted to take any action necessary to enable it to evaluate the transportation service options and to make arrangements for the continuation of such services following the Term of this Agreement, provided further, that such
