Compensatory Time Bank. An employee, at his option, may elect to accrue compensatory time at the rate of one-and-one-half (l-l/2) hours off for each hour of overtime work, and place such time in a comp-time bank. Once the employee has placed such time in the bank he must give a twenty-four (24) hour advance notice to the Chief of Police for comp time leave, except that such comp time would be permissible with a one (1) hour notice if the supervisor so granting such leave is of the opinion that doing so would not unduly disrupt the operations of the Department. The Employer shall have the sole discretion for granting such leave, but such denial should be for just cause and not mere inconvenience. The maximum accrual of compensatory time shall be 200 hours.

Compensatory Time Bank. Available hours are to be tracked and managed through Telestaff. This is to be referred to as an employee's “Comp Bank”. Employees may only hold a maximum of 24 hours in their Comp Bank at any given time. Available time in an employee’s Comp Bank will carry over from year to year. Upon the retirement of an employee, any time remaining in their Comp Bank will be considered forfeited and will not be compensated for.
Compensatory Time Bank. Employees, at their option, may accumulate up to four hundred and eighty (480) hours of compensatory time. Time will accumulate at the rate of one and one-half (1 1/2) hours for each hour worked. Upon separation from service for any reason, members shall be paid at their current rate of pay (per Article 17 Section 17.1) for all accumulated hours of time. An employee may roll over up to 40 hours per year into their vacation or holiday banks. (Same time as S.L.S.B.) When a member dies while in paid status in the City Service, any unused compensatory time to the member's credit shall be paid in a lump sum to the surviving spouse or the estate of the deceased.

Compensatory Time Bank. When an employee works overtime, he may elect to bank the hours as compensatory time (herein referred to as “reclaim time”) in lieu of receiving monetary compensation in that pay period. In consideration of the VILLAGE offering this limited compensatory or reclaim time benefit, the VILLAGE and the Union agree, in furtherance of Section 7(o)(5) of the Fair Labor Standards Act, to place restrictions on the use of compensatory time under circumstances which they agree would constitute an “undue disruption” of the Department’s operations. This banked time may be used to take time off at a future date when the leave calendar might otherwise be full and prevent normal scheduling of time off, or in the case of a personal emergency where time off is needed If a personal emergency should arise, hour for hour use is allowed if no overtime is required to cover the absence. Banked Reclaim Time may be accumulated in increments of no less than one-quarter hours at a time. Time shall be banked at a rate of 1.5 times the number of hours worked (e.g., 24 hours worked equals 36 hours banked). A maximum of 72 hours may be held in the bank at any one time. If time worked is to be banked, all of it must be banked (i.e., if 24 hours worked, all 36 must be banked if electing to do so). However, if the full amount would cause the balance accrued to exceed the maximum 72 hours, only that which will bring the balance to 72 hours will be banked and the remainder will be paid as overtime. The following procedure shall be followed for utilizing the Reclaim Time Bank not covered by Section 14.09:
Compensatory Time Bank. When an employee works overtime, he or she shall earn overtime at the FLSA rate. Following prior approval of overtime as described above, the employee will either be paid for the overtime worked, or the number of overtime hours worked will be placed in a compensatory time bank based on the employee’s request. The Finance Department (Payroll) will track the compensatory time accrued and used and the compensatory time balance will appear on the employee’s paycheck. Department Head approval will be required in order for employees to use time from the compensatory time bank.

Requests shall be granted in order of their submission. In case two or more requests are submitted on the same date for the same reclaim time off, unit seniority shall prevail. Under no circumstances shall overtime hours paid for in accordance with the Fair Labor Standards Act also be taken as compensatory time off. Overtime earned while working Special Outside Details, unless such details are required, shall be taken as pay only. It is the intent of both parties to continue compensatory time as described in this section, however, if any provision of this paragraph, by reason of any action by the appropriate legislative, administrative or judicial authority, becomes or is declared to be unlawful or unenforceable, this paragraph shall sunset and the unlawful or unenforceable provisions, or any other provisions directly impacted by them shall be open to negotiation upon thirty (30) days written notice by either party, as provided in Section 23.01, Savings Clause. In that case, all compensatory time accruals, as described herein, may be paid in cash unless and until new language is negotiated. Compensatory time is subject to the following limitations.

Compensatory Time Bank. Employees, at their option, may accumulate up to ninety-six (96) hours of compensatory time. Time will accumulate at the rate of one and one- half (1½) hours for each hour worked. Upon separation from service for any reason, members shall be paid at the employee’s current rate of pay for all accumulated hours of time. The parties agree that for the purposes of this Agreement, any request for the use of compensatory time that would result in fewer than one (1) employee in this bargaining unit to be working on a shift will result in a denial of the request for compensatory time, as it constitutes an undue hardship. Additionally, the parties agree that should a special circumstance exist, in the discretion of the Chief of Police, requiring more employees in this bargaining unit to be on shift, requests for compensatory time may be denied as constituting an undue hardship. Neither the employee nor the FOP-OLC shall be able to grieve a denial of compensatory time regarding either of the conditions found in this paragraph. Upon request, and approval by the Chief or the Chief’s designee, compensatory time may be taken in one (1) hour segments or more. When a member dies while in paid status in the City service, any unused compensatory time to the member’s credit shall be paid in a lump sum to the surviving spouse or the estate of the deceased.

Once the employee has placed such 2 time in the bank, he must give a twenty-four (24) hour advance notice to the Chief of Police for 3 comp time leave except that such comp time would be permissible with a one (1) hour notice if 4 the supervisor so granting such leave is of the opinion that doing so would not unduly disrupt the 5 operations of the Department. The Employer shall have the sole discretion for granting such 6 leave, but such denial should be for just cause and not mere inconvenience. The maximum 7 accrual of compensatory time shall be 200 hours. During the first year of this contract, current 8 employees with more than 200 hours of accrued compensatory time will be paid for their accrued 9 hours above 200. 10 11 Section 21.5 Pay Out Upon separation for any reason, the employee shall be paid for any 12 accumulation of accrued compensatory time. 13 14 Section 21.6 Pyramiding 15 16 There shall be no pyramiding of overtime or other rates of pay or other compensation 17 with any other pay rates unless specifically required by the terms of this Agreement. 18 20 ARTICLE 22
