Commitment to Reformulate or Warn. Commencing within 45 days of the Effective Date and continuing thereafter, Oatey agrees that all Products it sells or distributes for sale in California shall be either:
Commitment to Reformulate or Warn. As of the Effective Date, Donnamax shall not sell or offer the Subject Product for sale in the State of California unless they are Reformulated Products or Donnamax provides warnings that comply with Proposition 65 law.
Commitment to Reformulate or Warn. As of 30 days after the Effective Date, Fashion shall not sell or offer the Subject Product for sale in the State of California unless they are Reformulated Product as outlined in Section 2.2 or Fashion provides warnings as outlined in Section 2.3.
Commitment to Reformulate or Warn. As of the Effective Date, ITW shall not sell or offer the Subject Product for sale in the State of California unless they are Reformulated Products or ITW provides warnings that comply with Proposition 65 law.
Commitment to Reformulate or Warn. As of 30 days after the Effective Date, AKOAK shall not sell or offer the Subject Product for sale in the State of California unless they are Reformulated Products as outlined in Section 2.2 or AKOAK provides warnings as outlined in Section 2.3.
Commitment to Reformulate or Warn. As of the Effective Date, NRS shall not sell or offer the Subject Product for sale in the State of California unless they are Reformulated Products or NRS provides warnings that comply with Proposition 65 law.
Commitment to Reformulate or Warn. As of the Effective Date, Ahava shall not sell or offer the Subject Products for sale in the State of California unless they are Reformulated Products or Ahava provides warnings that comply with Proposition 65 law.
Commitment to Reformulate or Warn. As of 30 days after the Effective Date, Allura shall not sell or offer the Subject Products for sale in the State of California unless they are Reformulated Products as outlined in Section 2.2 or Allura provides warnings as outlined in Section 2.3.
Commitment to Reformulate or Warn. Bondhus further agrees, promises and represents that, as of the Effective Date, Bondhus shall not sell or offer the Subject Product for sale in the State of California unless they are (i) Reformulated Products; or (ii) Bondhus provides warnings that satisfy Section 2.3 of this Agreement. The requirements under this Section 2.2 of the Agreement shall not apply to any of the Subject Product that is already in the stream of commerce as of the Effective Date.
