Commissioning and Start Up. With the Owner’s maintenance personnel and the Consultants, direct the check- out of utilities, operations systems and equipment for readiness and assist in their initial commissioning, start-up and testing by the General Contractor.
Commissioning and Start Up. Promptly after Mechanical Completion has occurred, THE BUYER shall commence commissioning and start-up of the Plant in order to bring the Plant into a stable operating condition ready for performance testing. THE BUYER shall notify THE SELLER in writing 10 (ten) working days in advance of the number of personnel to be assigned for and the envisaged duration of the requested Advisory Services. Upon such written request, THE SELLER shall assign qualified personnel for and render Advisory Services during the commissioning, start-up and/or the subsequent performance testing of the Plant, as the case may be. Advisory Services shall not exceed $200,000.00, for commissioning, startup and performance testing of the plant, in Article 5.2, unless delays extend the period of Advisory Services due to errors by persons other than THE SELLER. The foregoing limitation excludes any Advisory Services that may be requested by BUYER of SELLER not in conjunction with commissioning, startup and performance testing related activities.
Commissioning and Start Up. (Budget Period 2) - This task includes component testing and the commissioning of all components of the project, from core processes to buildings and utilities. This task also includes sequential start-up of the facility and operation to a steady- state.
Commissioning and Start Up. After the Xxxxx Complex is Mechanically Complete, Owner shall, with the oversight and cooperation of the Contractor and the Independent Engineer, commence Commissioning and Start-up of the Xxxxx Complex. Contractor shall be responsible for monitoring Commissioning and Start-up in order to determine whether such activities are conducted in accordance with this Contract, the Start-up Protocol, the Standards, good operating practices and in conformance with the requirements of the Turnkey Specifications and shall provide immediate oral notice to Owner's Representative and the Independent Engineer, confirmed in writing within five (5) days, if any part of Commissioning or Start-up is not conducted in accordance with such requirements. Contractor shall not have any defense to its liabilities hereunder based on improper procedures or any other occurrences or conditions whatsoever during Commissioning unless notice is timely given as required in the preceding sentence. In addition, Contractor shall have the right to request that Owner, and Owner agrees to, stop any Commissioning or Start-up activities that Contractor reasonably believes will adversely affect the operation of the Xxxxx Complex or achievement of the Guaranteed Values. Owner's failure to comply with such requests or to follow the Start-up Protocol shall entitle Contractor to a claim of Owner-Caused Delay, provided, however, that any delay failure to abide by the Start-up Protocol by -------- ------- the Contractor shall not entitle the Contractor to any claims for Owner-Caused Delay.

  • Commissioning Commissioning tests of the Interconnection Customer's installed equipment shall be performed pursuant to applicable codes and standards. If the Interconnection Customer is not proceeding under Section 2.3.2, the Utility must be given at least ten (10) Business Days written notice, or as otherwise mutually agreed to by the Parties, of the tests and may be present to witness the commissioning tests.
