Common use of Commercial Use Clause in Contracts

Commercial Use. Use of the Licensed Materials for the purposes of monetary reward by means of sale, resale, loan, transfer, hire, or other form of commerce. For the avoidance of doubt, neither recovery of direct costs exclusive of the Fee by any Member from Authorized Users, nor use by the Licensee or Authorized Users of the Licensed Materials in the course of research funded by a commercial organization, nor the payment of a fee by a person in order to be registered with the Member, is deemed to constitute Commercial Use.

Commercial Use. Use of the Licensed Materials To use for the purposes of monetary reward (whether by or for the Licensee or an Authorized User) by means of sale, resale, loan, transfer, hire, hire or other form of commerceexploitation of the Licensed Materials. For the avoidance of doubt, neither recovery of direct costs exclusive of by the Fee by any Member Licensee from Authorized Authorised Users, nor use by the Licensee or Authorized Users by an Authorised User of the Licensed Materials Material in the course of research funded by a commercial organization, nor the payment of a fee by a person in order to be registered with the Memberorganisation, is deemed to constitute Commercial Use.
