Collective/Class Action Waiver. If any claim is not subject to release, to the extent permitted by law, Employee waives any right or ability to be a class or collective action representative or to otherwise participate in any putative or certified class, collective or multi-party action or proceeding based on such a claim in which Employer or any other Releasee identified in this Agreement is a party.

To the fullest extent permitted by law, Employee waives any right or ability to participate in a collective action, class action, or multi-party action adverse to any of the Releasees for any conduct that occurred prior to signing this Agreement. Employee affirmatively promises not to opt in or otherwise participate in any way in any such action. Employee understands and agrees that a breach of this collective/class action waiver entitles any impacted Releasee to affirmatively pursue a breach-of-contract claim against Employee, in addition to a right of set-off and any other available relief.

Xxxxxx waives any right or ability to be a class or collective action representative or to otherwise participate in any putative or certified class, collective or multi-party action or proceeding based on such a claim in which Monro or any other Releasee identified in this Agreement is a party.
