Clearing of Trees and Brush. A. If trees are to be removed for the Construction or Deconstruction of a Facility, the Facility Owner shall consult with the Landowner to determine if there are trees of commercial or other value to the Landowner.

Clearing of Trees and Brush. A. If trees are to be removed for the Construction or Deconstruction of a Commercial Solar Energy Facility, the Commercial Solar Energy Facility Owner will consult with the Landowner to determine if there are trees of commercial or other value to the Landowner.
Clearing of Trees and Brush from the Easement If trees are to be removed from privately owned land, the Company will consult with the Landowner to see if there are trees of commercial or other value to the Landowner that are slated to be removed. If there are trees of commercial or other value to the Landowner, the Company will allow the Landowner the right to retain ownership of the trees with the disposition of the trees to be negotiated prior to the commencement of land clearing. The Company will follow the Landowner’s desires, if reasonable, regarding the disposition of trees and brush of no value to the Landowner by burning, chipping or complete removal from any affected property.

  • Felling of trees The Authority shall assist the Concessionaire in obtaining the Applicable Permits for felling of trees to be identified by the Authority for this purpose if and only if such trees cause a material adverse effect on the construction, operation or maintenance of the Bus Terminal. The cost of such felling shall be borne by the Authority, and in the event of any delay in felling thereof for reasons beyond the control of the Concessionaire, it shall be excused for failure to perform any of its obligations hereunder if such failure is a direct consequence of delay in the felling of trees. For the avoidance of doubt, the Parties hereto agree that the felled trees shall be deemed to be owned by the Authority and shall be disposed in such manner and subject to such conditions as the Authority may in its sole discretion deem appropriate.
