Clean Air and Clean Water. Supplier agrees to comply with the inspection and other requirements of the Clean Air Act, as amended (42 USC § 7401 et seq.), and the Federal Water Pollution Control Act, as amended (33 USC § 1251 et seq.). Supplier agrees it will not use any violating facilities, it will report the use of facilities placed on or likely to be placed on the U.S. Environmental Protection Agency (EPA) “List of Violating Facilities,” and it will report any violation of use of prohibited facilities to the City. Supplier understands and agrees that the City will, in turn, report each violation, as required, to assure notification to the Federal Transit Administration and the appropriate EPA Regional Office.
