Classified Information. In no event shall any of the Copyright Collateral, Patent Collateral or Trademark Collateral include any Copyright, Patent or Trademark, any application for a Copyright, Patent or Trademark, or any license or right under any Copyright, Patent or Trademark that is “classified” for reasons of national security or foreign policy under applicable laws or with respect to which Pledgor is not entitled to pledge, sublicense or assign pursuant to its terms or applicable law or regulation.

For the purposes of this clause 15.11: Classified Information includes: any Commonwealth document marked with a national security classification; and any information or document that the Consultant knows or ought to know is subject to, or ought to be treated in accordance with, the provisions of the Defence Security Manual; and Defence Security Manual is a reference to that document as amended from time to time. Manual of Fire Protection Engineering and Building Code of Australia Certification Without limiting clauses 2.10, 2.12 or 6.13, the Consultant must provide to the Contractor's Representative written certification from an Accredited Building Surveyor: at the time it submits any Design Documentation under clause 6.2 - that the Design Documentation submitted at that time complies with the MFPE and the Building Code of Australia; and prior to Completion (as defined in the Managing Contractor Contract) of the MCC Works or a Stage (as defined in the Managing Contractor Contract) - that the MCC Works comply or the Stage (as defined in the Managing Contractor Contract) complies (as the case may be) with the MFPE and the Building Code of Australia, except to the extent of any dispensation granted by the ASEE and set out in the certification.
