Class Representative Service Payment. Class Counsel intends to request a Class 7 Representative Service Payment for Plaintiff. Class Counsel may seek a service payment not to exceed 8 $3,500. Any Class Representative Service Payment would be in addition to the Class Representative’s 9 Individual Settlement Payment.
Class Representative Service Payment. A sum not to exceed $5,000.00 payable to Plaintiff as consideration for her service as the named class representative, which sum shall be paid from the Settlement Fund, subject to Court approval.
Class Representative Service Payment. Defendants agree that Plaintiff may apply to the Court for a Class Representative Service Payment in an amount not to exceed $7,500.00. Plaintiff will file his request for approval of Class Representative Service Payment no later than fourteen (14) days before the hearing on the Motion for Final Approval. Defendants agree not to oppose the motion for such service payment. The Settlement Administrator shall pay any approved Class Representative Service Payment no later than five (5) days after the Effective Date.
Class Representative Service Payment. Class Representative Service Payment to the Class Representative of not more than $7,500, which is in addition to any Individual Class Payment and any Individual PAGA Payment the Class Representative is entitled to receive as a Participating Class Member. XXXXXXX will not oppose Plaintiff’s request for a Class Representative Service Payment that does not exceed this amount. As part of the motion for Class Counsel Fees Payment and Class Litigation Expenses Payment, Plaintiff will seek Court approval for any Class Representative Service Payments no later than 16 court days prior to the Final Approval Hearing. If the Court approves a Class Representative Service Payment less than the amount requested, the Administrator will retain the remainder in the Net Settlement Amount. The Administrator will pay the Class Representative Service Payment using IRS Form 1099. Plaintiff assumes full responsibility and liability for employee taxes owed on the Class Representative Service Payment.
Class Representative Service Payment. Subject to approval by the Court, Class Representative Xxxxxxx Xxxxxx will receive a Class Representative Service Payment in an amount not to exceed $15,000, for her services as Class Representative and in exchange for her executive a General Release of all claims against Defendants. This payment will be deducted from the Gross Settlement Amount.
Class Representative Service Payment. Subject to Court approval 4 and the provisions of Section 9(c), infra, L&M shall compensate the Class 5 Representative for services rendered for the benefit of the Plaintiff Class, and for 6 risks assumed on behalf of the Plaintiff Class, in the total sum of $5,000. L&M shall 7 not object to, or file any papers in relation to, the Class Representative’s request for
Class Representative Service Payment. The Parties acknowledge that Plaintiff will apply to the Court for approval of the Class Representative Service Payment in the amount of $2,500 in recognition of her efforts and activities in furtherance of both the litigation and this Agreement. The Class Representative Service Payment shall be paid from the Cash Settlement Fund and will not be distributed to Plaintiff until after the Settlement Date. The Parties further agree that Elixir will not be obligated to pay any Class Representative Service Payment in excess of $2,500. If the Court approves the Agreement and the Class Representative Service Payment to Plaintiff, the Class Representative Service Payment approved by the Court will be paid by the Settlement Administrator within ten (10) calendar days after entry of the Final Order and Judgment. The Parties represent that their negotiation of, and agreement to, the compensation paid to Plaintiff did not occur until after the substantive terms of the Agreement had been negotiated and agreed. No interest shall be paid on the Class Representative Service Payment.
Class Representative Service Payment. The amount the Court awards to Plaintiff Xxx Xxxxx as a Class Representative, which will not exceed $5,000.

Class Representative Service Payment. In addition to his Settlement Share, Plaintiff will apply to the Court for a Class Representative Service Payment of not more than $10,000. Defendant will not oppose such an application for a Class Representative Service Payments to Plaintiff. The Settlement Administrator will pay the Class Representative Service Payment approved by the Court out of the Gross Settlement Amount. If the Court approves a Class Representative Service Payment of less than $10,000 for Plaintiff, the other terms of the settlement will remain in effect and the remainder will be retained in the Net Settlement Amount for distribution to Participating Class Members. Payroll tax withholding and deductions will not be taken from the Class Representative Service Payment and instead a Form 1099 will be issued to Plaintiff with respect to his payment. Plaintiff shall be solely responsible for any tax obligations with respect to this payment. To receive this court-approved payment, the Plaintiff agrees to a California Civil Code section 1542 waiver and a general release of all claims that may be released upon the Settlement Effective Date. Plaintiff also agrees to provide completed IRS Forms W-9 in order to receive these payments.
