Class Grievance. Class grievances involving one or more employees or one or more supervisors, and grievances involving an administrator above the building level may be initially filed by the Association at Step II.
Class Grievance. Class grievances involving one or more employees or one or more supervisors, and grievances involving an administrator above the building level may be initially filed by the Association as Step III.
Class Grievance. A class grievance involving more than one (1) teacher and/or one (1) or more supervisors shall be initially filed by the Association at Step 2.
Class Grievance. Upon agreement of the Superintendent, two or more grievances involving a common substantive issue or issues may be filed by the Association as a class grievance.
Class Grievance. A class grievance is a grievance within the definition of this Article, which affects or has an impact on more than one employee in the same manner. Such grievance may be filed by any one member of the class or the union, provided that the grievance identifies descriptively the class and the employees affected.
Class Grievance. 15.5.1 A class or group grievance may be filed when one (1) set of circumstances or occurrences affects more than one (1) grievant in the same manner or to the same extent.
Class Grievance. A general violation, misinterpretation, or misapplication of the Agreement that directly affects three (3) or more bargaining unit members.
Class Grievance. The Union may file a Class Grievance if it affects two (2) or more Faculty Members whose complaints involve the same questions of fact and contract provision(s) so that a decision as to one (1) grievant shall be decisive as to all members of the Class. In filing a Class Grievance, the Union shall set forth, in addition to the requirements for filing a formal grievance, (1) the questions of fact which are common to all members of the Class, (2) the identification of all members of the Class known to the Union, (3) a statement as to whether or not the members of the Class have been notified and given opportunity to be included or excluded from the Class, and (4) the name of the Faculty Member who shall serve as representative of the Class for the purpose of determining the questions of fact and alleged contract violation. In matters of contract interpretation affecting the entire bargaining unit, the Union may file a Class Grievance on its own initiative. Such a grievance shall identify the sections of the Agreement being violated through the policies or the actions of the Employer. The Union shall represent the entire bargaining unit in the Class Grievance, there shall be no exclusion procedure or required notification of the bargaining unit, and the resolution of the grievance shall apply to the entire bargaining unit. If a Class Grievance involves more than one (1) component of the University, i.e., the University of Hawaii at Manoa, the University of Hawaii at Hilo and the University of Hawaii-West Oahu, or the Community Colleges, the grievance may be filed initially at Step 2.
Class Grievance. Class grievance involving one or more certified teachers or one or more supervisors, and grievances involving an administrator above the building level may be initially filed by the Association as provided in the FORMAT LEVEL of this article.
Class Grievance. A class grievance may be filed at Step 2 by mutual agreement between the Union and the Employer or the Employer’s designee within the time limits in Section 15.11.
