Common use of Claims Handling Clause in Contracts

Claims Handling. 6.1 Claims Handling service requirements will be specified by the Contracting Body in the Call Off Contract, and the Broker should respond to that, taking into account any in-house or other incumbent capability. 6.2 Should the Broker sub contract out the claims handling service, the selected Broker shall remain responsible for the service including the management of their sub contractors. 6.3 The Broker shall make all reasonable endeavours to ensure that any costs for which the Contracting Bodies is liable are minimised 6.4 Claim notification details will be agreed with the Contracting Bodies in the Call Off Contract. 6.5 The Broker must ensure: 6.5.1 Conflicts of interest are managed and disclosed; 6.5.2 Claims are handled fairly; 6.5.3 Claims are settled promptly; and 6.5.4 The Contracting Body must be provided with information on the claims handling process, and with an explanation of why a claim is rejected or not settled in full, where relevant. 6.6 The Contracting Body may require an on line solution. This will be confirmed by the Contracting Body in the Call Off Contract.
