CITY COUNCIL REVIEW. On the 26th day of April, 2021, the City Council reviewed the application, the reports and recommendations of the City’s staff and consultants; the reports and requests of the Developer; and the recommendations of the City Planning Commission; and has approved the PUD Master Plan Amendment and the Phase 3Final Plan, all subject to the terms and conditions contained herein.

CITY COUNCIL REVIEW. If a request is filed, the City Council shall review the Hearing Officer's decision.
CITY COUNCIL REVIEW. Upon receiving the appeal, the City Council shall schedule a hearing with the employee at a regular, adjourned, or special meeting of the City Council. Following the conclusion of the hearing, and not later than the second regularly scheduled meeting thereafter, the City Council shall render its decision. The City Council's decision shall be final.

The findings of fact and conclusions of law shall be final and binding unless within thirty (30) calendar days after receipt thereof a written request for review by the City Council is filed with the Personnel Officer or his/ her designated authorized representative. A written request for review by the City Council may be filed by the employee (or his/her representative or legal counsel), the Department Head of the employee ’s department (or legal counsel), any member of the City Council, the City Manager, or the Personnel Officer. The Personnel Officer will notify all parties that the request for review has been filed. The City Council shall conduct said review within six (6) weeks of receipt of the appeal.
CITY COUNCIL REVIEW. The decision of the arbitrator within the limits herein prescribed shall be in the form of a recommendation to the City Council. However, if the City Council declines to review the arbitrator’s recommendation, said recommendation shall be deemed binding upon both the City and the IAFF, Local 1906 and the grievant. If the City Council decides to review the arbitrator’s recommendations, it must undertake such review no later than the second regularly scheduled Council meeting following issuance of the recommendation. At a minimum, such review, which may be requested by either party, shall include a review of the hearing record and briefs submitted by the respective parties. The Council may, if it deems appropriate, permit oral arguments by representatives of the parties as well as asking for additional written or oral evidence. In the event of such request, the presentation or argument and/or evidence must be in the presence of both parties. Within thirty (30) working days after receiving the record, the City Council shall render a decision on the matter, which decision shall be final and binding on all parties subject to the following provision: in order to reject the advisory arbitrator’s recommendations, the City Council’s vote must be by a margin of four to one or better. If the Council does not render such a decision within the specified time limits, then it shall be deemed to have adopted the arbitrator’s recommendations.

CITY COUNCIL REVIEW. On the 25th day of July, 2016, the Arden Hills City Council (“City Council”) reviewed the Phase 2-Final Plan, the reports and recommendations of the City’s staff and consultants; the reports and comments of Developer; and the recommendation of the City Planning Commission; and has approved the Phase 2-Final Plan, including approval of all variances from ordinance codes or other requirements necessary to complete all of the improvments contemplated by or relating to the Development; all subject to the terms and conditions contained herein.
CITY COUNCIL REVIEW. If the employee is not satisfied with the decision, the employee may request a hearing before the City Council. Such request for hearing must be submitted in writing within fifteen (15) days of receipt of the City Manager’s decision and shall include in detail the facts giving rise to the general grievance and all supporting documentation necessary for City Council consideration. Management shall calendar on the City Council Agenda such request and supporting documentation within thirty (30) days. The matter may be heard in open or closed session as permitted by law. The City Council shall have the following options: (1) refuse to hear the appeal; (2) make a decision on the documentation submitted; or (3) hold a hearing after which they shall make a decision. The decision of the City Council shall be final.

Such reviews shall be conducted for the purpose of providing Xx.
