City Authorization. When the term City is used in this agreement, it shall mean the government of the City of Warrensburg, Missouri or the City of Warrensburg City Council, as the context requires. Authorization by the City shall mean written instruction from the City Council or the City Manager. It is further understood and agreed that no person or party is authorized to bind the City to any proposed agreement for services under the auspices of this agreement without having obtained the prior approval of the City of Warrensburg City Council or City Manager. In this regard, it is understood and agreed that the Supplier shall not be entitled to rely upon verbal representations by any agent or employee of the City in deviation to the terms and conditions of this agreement or as authorization for compensation for services except as may be approved by the City Council or City Manager in writing. When the term City's representative is used, it shall mean the City Manager or his designee as specified in writing.
City Authorization. Pursuant to Government Code Section 65865, City has adopted procedures and requirements for consideration of development agreements which are contained in Lincoln Municipal Code Chapter 18.80. This Development Agreement has been processed, considered and executed in accordance with such procedures and requirements.
City Authorization. As a provider of management services for the City’s Project, Lane4 will frequently rely on City feedback, approvals, and authorization to proceed with aspects of Lane4’s services hereunder. The Parties agree that Lane4 may rely on written feedback, approvals, and authorization from the City Manager, City Attorney, City Council, or any other person delegated such authority in writing by any of the aforementioned (the “City Authorities”). In no event will Lane4 have any liability under this Agreement for relying on the City Authorities or waiting to proceed with any given activity hereunder until written feedback, approvals, or authorization, as applicable, is received from one or more City Authorities.
City Authorization. The City shall have duly adopted an ordinance approving an agreement between Landlord and the City that approves the execution by Landlord of this Agreement and the other documents related hereto.
City Authorization. The department director shall recommend approval or disapproval and forward the request to the Human Resources Department, whose decision shall be final. Having approved the course of study, Human Resources returns the application to the department, until such time as the course is complete. If a course is approved and later found to be unavailable, a substitute course must be approved.
City Authorization. For the purpose of this Agreement, the Department will act on behalf of the CITY in the fiscal control, programmatic monitoring and modification of this Agreement, except as otherwise provided in this Agreement.
City Authorization. The execution of this Agreement by the City was authorized by resolution of the City Council adopted June , 2009.
City Authorization. City hereby grants and delegates to Contractor the authority and the responsibility necessary to permit Contractor to perform its duties under this Agreement and agrees to take such additional steps as are necessary to evidence such delegation and authorization as is reasonably requested by Contractor subject to the limitations set forth in Section 9. City hereby grants to Contractor the exclusive use and occupancy of the Facility during the term of this Agreement or any renewal hereof for said purposes. City shall not grant to any third party any rights to the use or occupancy of all or any part of the Facility during the term of this Agreement without the written permission of Contractor unless this Agreement specifically provides otherwise, which permission shall not be unreasonably withheld.
City Authorization. City hereby grants and delegates to Operator the authority and the responsibility necessary to permit Operator to perform its duties under this Operating Agreement, and to do any and all acts deemed necessary or desirable for operation and maintenance of the Premises and agrees to take such additional steps as are necessary to evidence such delegation and authorization as is reasonably requested by Operator. City hereby grants to Operator the use and occupancy of the Premises during the Term and any extension thereof. Except as otherwise stated in this Operating Agreement, City shall not grant to any third-party any rights to use or occupy all or any part of the Premises during the Term without Operator’s written consent.
