CIRCUMSTANCES BEYOND CONTROL. Xxxxxx shall not be liable under this Agreement in any case where Xxxxxx is prevented from carrying out its obligations under this Agreement by circumstances beyond its control. Xxxxxx shall not be liable for the cost of any repairs where approval for such repairs has not been given by the Warranty Administrator of Xxxxxx prior to commencement.
CIRCUMSTANCES BEYOND CONTROL. Landlord shall not be liable for any failure of Maintenance Obligations or Service Obligations when such failure is caused by (i) strikes, lockouts or other labor disturbance or labor dispute of any character, (ii) governmental regulation, moratorium or other governmental action, (iii) inability despite the exercise of reasonable diligence to obtain electricity, water or fuel from the providers thereof, (iv) acts of God or (v) any other cause beyond Landlord's reasonable control.
CIRCUMSTANCES BEYOND CONTROL. The Custodian shall not be responsible or liable for (i) special, consequential, indirect or punitive damages or (ii) any failure or delay in the performance of its obligations under this Agreement arising out of or caused, directly or indirectly, by circumstances beyond its reasonable control, including, without limitation (to the extent beyond its reasonable control), acts of God, earthquakes, fires, floods, wars, civil or military disturbances, sabotage, epidemics, riots, interruptions, loss or malfunctions of utilities, computer (hardware or software) or communications service, accidents, labor disputes, acts of civil or military authority or governmental actions.
CIRCUMSTANCES BEYOND CONTROL. 25.1. Kora shall not be liable for any delay or failure to supply the Products, or to meet any other obligations owed to the Customer, where such delay, failure or omission is due to circumstances beyond the reasonable control of Xxxx.
CIRCUMSTANCES BEYOND CONTROL. Whenever a vendor’s place of business, mode of delivery, or source of supply has been unduly impacted by abrupt changes in world markets or disrupted by acts of government, God, civic commotion, or war, it shall be the responsibility of the vendor to promptly advise the Contract Administrator, in writing, as to the extent of this disruption presented is commensurate with the conditions established herein. The Contract Administrator may elect to modify delivery/service, timelines, renegotiate the contract in whole or in part, or cancel any open orders in accordance with Special Conditions 5.0. The vendor will be given written notification of all decision made.
CIRCUMSTANCES BEYOND CONTROL. The PPO shall not be in violation of this Certificate if it is prevented from performing any of its obligations hereunder for reasons beyond its control. These may include, but are not limited to, any of the following: acts of God, war, strikes, statutes, rules, regulations or interpretations of statutes and regulations to which the PPO is subject. In the event the Covered Services which the PPO has agreed to provide are substantially interrupted including, but not limited to, the significant partial destruction of the PPO’s administrative offices, or a significant partial disability of the Network, pursuant to any such events, the PPO shall make a reasonable effort to arrange for an alternative method of providing care.
CIRCUMSTANCES BEYOND CONTROL. 40.1 If the Contractor is prevented from performing its obligations under this Head Agreement due to circumstances beyond the Contractor’s reasonable control (for example acts of God, natural disasters, acts of war, riots and strikes outside that party’s organisation), the Contractor must give Notice of such circumstances to the Finance Representative (and provide a copy to any Agencies affected) as soon as possible, identifying the specific effect those circumstances will have on its performance of this Head Agreement.

No party may be held responsible to the other party for any defect or delay in the execution of the program causes by circumstances beyond their control including, but not limited to, natural disasters, fires, work strikes, or any governmental measures, the latter including 20 intervention by the Quebec or Ontario Securities Commission.

CIRCUMSTANCES BEYOND CONTROL. The City shall not be responsible if the City Wastewater System is prevented from receiving or treating wastewater from the District in accordance with the terms of this Agreement by any cause not reasonably within the control of the City including, but not limited to, acts of God (fire, explosion, flood, earthquake, tornado), strike, war, unavoidable accident, ruptured pipe resulting from temperature change or ground disturbances, or Federal or State interference (governmental exercise of authority, court orders). The City agrees (except in the case of total destruction or near total destruction of its properties) to diligently put its works in condition again, as soon as practicable, to dispose of sewage in the manner provided for in this Agreement.
