Chief Deputy. Should the member-grievant not be satisfied with the answer in Step 1, within seven (7) calendar days of the receipt of the answer, he may appeal the grievance by delivering a copy of the Grievance Form attached to any written response at the prior Step and any other pertinent documents to the Chief Deputy or his designee. The Chief Deputy or his designee shall date the form, accurately showing the date his office received the Form. Within seven (7) calendar days of his receipt of the Grievance Form, the Chief Deputy shall schedule and conduct a meeting to discuss the grievance with the grievance representative or his designee and the member-grievant. The Chief Deputy may bring any appropriate witnesses. In the meeting called for at this Step, the Chief Deputy shall hear a full explanation of the grievance and the material facts relating thereto. Within seven (7) calendar days of the meeting at this Step, the Chief Deputy shall submit to the grievance representative and the member-grievant his written response to the grievance.

Chief Deputy. In order for a grievance to receive consideration under this procedure, the grievance must be submitted by email to XXXXXxxxxxxxx@xxxxxxxxxxxxxxxxxx.xxx within fourteen (14) days of the occurrence that gave rise to the grievance or date when the grievant should have known of the occurrence, whichever comes later. Human Resources shall forward the grievance to the appropriate Chief Deputy. The Chief Deputy shall have ten (10) days in which to schedule a meeting, unless the meeting is waived by mutual agreement, with the aggrieved employee and the employee’s representative, if applicable. The Chief Deputy shall respond in writing to the grievance, on the agreed upon grievance form, within ten (10) days following the meeting date.

Chief Deputy. If the grievance is not resolved in Step 1, the grievance shall be reduced to writing on the form attached hereto as Appendix B stating the complete facts of the complaint, the section(s) of the Agreement allegedly violated, and the relief requested. Chief Deputy. If the employee and the immediate supervisor are unable to resolve the problem at the Informal Step, the employee may file a written grievance with the Chief Deputy. In order for the grievance to be considered timely filed, it must be filed within five (5) working days from the date of the Immediate Supervisor's response at the Informal Step. Within (5) working days from the date the aggrieved first presented his complaint, the Chief Deputy will attempt to resolve the matter. Step 2: Sheriff If the grievance is not satisfactorily resolved in Step 1, the aggrieved, with the appropriate FOP Representative if the aggrieved so desires, may refer the grievance to the Sheriff within five (5) days after receiving the Step 1 reply. The Sheriff shall have five (5) working days in which to schedule a meeting with the grieved employee and the appropriate FOP representative. The Sheriff shall investigate and respond to the grievant and FOP representative within ten (10) working days following the meeting. Oral and or Written reprimands will not proceed any further. Step 3: Arbitration If the grievance is not settled in Step 2, the FOP may make a written notice that the grievance is submitted to arbitration. Such notice shall be submitted within thirty (30) working days following the date the grievance was answered in Step 2 of the grievance procedure. In the event the grievance is not referred to arbitration within the time limits prescribed, the grievance shall be considered resolved based upon the Step 2 reply.

Less senior employees will be reclassified as Clerks and shall no longer receive the Chief Deputy stipend. The amount of any remaining stipend may not be increased, decreased, or abolished without collective bargaining between the Employer and the Union.
