Character of Workers. The Contractor must employ only competent and efficient workers and whenever, in the opinion of the City, any such worker is careless, incompetent, violates safety or security rules, obstructs the progress of the work or services to be performed under this Contract, acts contrary to instructions or acts improperly, or fails to follow the safety requirements of this Contract, the Contractor must, upon request of the City, discharge or otherwise remove such worker from the work or services to be performed under this Contract and must not use such worker again, except with the written consent of the City. The Contractor must not permit any person to work upon the work or services to be performed under this Contract or enter into any buildings connected therewith who is under the influence of intoxicating liquors or controlled substances.

Character of Workers. 4.7.1 CONTRACTOR shall have in place and enforce a drug-free workplace policy which complies with the requirements of the Drug-Free Workplace Act.

The Contractor must not permit any person to enter any part of the Work or any buildings connected therewith who is under the influence of intoxicating beverages or controlled substances.
Character of Workers. If, in the sole and subjective opinion of any one, all, or a combination of the Contractor, the Architect, or the Owner, anyone employed by Subcontractor on the Project is deemed to be unfit for its duties, or find that any one, all, or a combination of any of Subcontractor’s employees, agents, or subcontractors acts in an unsafe, unprofessional, or unacceptable manner, Subcontractor shall immediately upon reasonable notice remove said employee, agent, or subcontractor from the Project, and said employee, agent, or subcontractor shall not again be allowed to work on the Project without prior written permission from Contractor. Similarly, should any superintendent or xxxxxxx be deemed incompetent or unfaithful in the execution of the Subcontractor’s Work, Subcontractor shall remove said employee forthwith from the Project and Subcontractor shall not employ that employee thereafter on any part of the Project.
Character of Workers. Competent supervisor and subcontractors shall be employed on work requiring special qualifications. Any subcontractor whose performance or conduct is disorderly, dangerous, insubordinate, or incompetent shall be removed immediately from the work upon such performance or conduct becoming known to DEVELOPER or DEVELOPER’S supervisor and such person shall not again be employed on the work. To the fullest extent permitted by law, DEVELOPER agrees to indemnify and hold harmless CITY, its elected and appointed officials, officers, directors, attorneys, agents (including outside consultants) and employees, and each of them from and against any claim of any person or persons, including attorneys' fees, in any way arising from the removal of such person or persons under this subsection e. This subsection g. shall survive the termination or completion of this Agreement for the full period of time allowed by law.

Character of Workers. The Contractor shall not allow his/her agents or employees, Subcontractors, or any agent or employee thereof, to trespass on premises or lands in the vicinity of the Work. Only skilled foremen and workers shall be employed on Work requiring special qualifications, and when required by the Director, the Contractor shall discharge any person who commits trespass, or in the opinion of the Director, acts in a disorderly, dangerous, insubordinate, incompetent, or otherwise objectionable manner. Any employee being intoxicated or bringing or having intoxicating liquors or controlled substances on the Work shall be discharged. Such discharge shall not be the basis of any claim for compensation of damages against the City or any of its officers, agents, and employees.

The Contractor shall ensure workers have the experience and skills to perform assigned Work. The Contractor shall remove employee(s) who perform the Work in an unskilled manner, is in eligible to perform the Work, or who is intemperate or disorderly. The Contractor shall allow these employees to return to the Project only with the Project Manager’s written permission. If the Contractor or its employee(s) fail to comply with these requirements the Project Manager may suspend the Work at no cost to The T/LPA.
