Change in Funding. Contractor understands and agrees that County shall have the right to terminate this Agreement immediately upon written notice to Contractor in the event that any State and/or Federal agency and/or other funder(s) reduce, withhold, or terminate funding which County anticipated using to pay Contractor for services provided under this Agreement, or in the event that County has exhausted all funds legally available for payments due under this Agreement.

Change in Funding. If the funding authorities of the DEPARTMENT (Federal, State, and local agencies) fail to appropriate funds to enable the DEPARTMENT to continue payment as specified in this Agreement or if the Board of Health reduces the budget of the DEPARTMENT or any program(s) and, as a result of the Board of Health’s action, the DEPARTMENT’s Director of Health determines there are insufficient funds to continue payment as specified in this Agreement, then the DEPARTMENT may modify or cancel this Agreement without penalty provided that the Local Health Jurisdiction receives at least ninety (90) days prior written notice of lack of appropriated funds as the reason for the modification or termination. Any modification of this Agreement shall be effective only upon incorporation into a written amendment as set forth in Section XI.
Change in Funding. If, during the Alliance Term and as a result of changes in funding for the Project, Main Roads directs the Participants to substantially change the D&C Program with effect that significant additional Works are required to be performed by the Participants or a significant part of the Works are required to be omitted, the Alliance Board must promptly meet and decide how, and under what conditions, if any, this Agreement is to proceed.

Change in Funding. The Contractor expressly acknowledges that the funding for the Division is subject to legislative change by either the federal or state governments. If either legislative body should enact measures which alter the funding for the Division, the Contractor shall not hold the Division liable in any manner for the resulting changes. The Division shall use best efforts to provide 30 days’ written notice to the Contractor of any legislative change. During the 30-day period, the parties shall meet and make a good faith effort to agree upon changes to this Contract to address the legislative change. Nothing in this Section shall affect or impair the Division’s right to terminate this Contract pursuant to the termination provisions, and no payments shall be due to Contractor under the Contract.

Change in Funding. Contractor understands and agrees that SCTA shall have the right to suspend this Agreement upon written notice to Contractor in the event that (1) any state or federal agency or other funder reduces, withholds or terminates funding which the SCTA anticipated using to pay Contractor for services provided under this Agreement or (2) SCTA has exhausted all funds legally available for payments due under this Agreement. Contractor and SCTA will work together in good faith to pursue all other funding options.
Change in Funding. Within five (5) business days after Provider receives notice of any change in the amount of funding under the BBHC Agreement or in Additional Local Matching Funds, Provider must report to County in writing the change, along with documentation sufficient to validate the change (if documentation is requested by County).
