Center Construction Timeframe. Developer agrees to use reasonable commercial efforts to: (i) have the plans prepared and all approvals thereof required by applicable governmental authorities obtained; (ii) have all necessary permits for grading to be issued by all applicable governmental authorities; (iii) have grading pursuant to the respective plans therefore commenced; and (iv) have all necessary permits for construction pursuant to the respective plans therefore to have been issued by all applicable governmental authorities ("Commencement of Construction") of the Center no later than one calendar year after the Effective Date of this Agreement, and subject to events of Force Majeure to cause (i) substantially completed in accordance with the approved plans; (ii) a certificate of substantial completion has been issued by the architect(s); and (iii) certificates of occupancy have been issued for two Anchor Stores and a minimum of 200,000 square feet of retail space in the Center to occur on or before the expiration of three years after Commencement of Construction (the "Opening Date"). The Center may be constructed in separate phases.

  • Project Construction The Contractor agrees to provide continuous on-site supervision on each Job Order, while progress on the project is being accomplished. The Contractor’s Project Manager will ensure:

  • Participating TO's Interconnection Facilities Construction The Participating TO's Interconnection Facilities shall be designed and constructed in accordance with Good Utility Practice. Upon request, within one hundred twenty (120) Calendar Days after the Commercial Operation Date, unless the Participating TO and Interconnection Customer agree on another mutually acceptable deadline, the Participating TO shall deliver to the Interconnection Customer and the CAISO the following “as-built” drawings, information and documents for the Participating TO's Interconnection Facilities [include appropriate drawings and relay diagrams]. The Participating TO will obtain control for operating and maintenance purposes of the Participating TO's Interconnection Facilities and Stand Alone Network Upgrades upon completion of such facilities. Pursuant to Article 5.2, the CAISO will obtain Operational Control of the Stand Alone Network Upgrades prior to the Commercial Operation Date.

The Connecting Transmission Owner [shall/shall not] transfer operational control of the Connecting Transmission Owner’s Attachment Facilities and Stand Alone System Upgrade Facilities to the NYISO upon completion of such facilities.

  • BUILDER’S RISK FOR CONSTRUCTION RENOVATION PROJECTS If the project is CONSTRUCTION RENOVATION of an existing structure, and the State has already determined that Contractor will not be obligated to obtain and maintain Builder’s Risk insurance, then the following provisions apply:

  • Commencement and Completion of Construction The Company shall begin Construction Activities no later than January 1, 2014 (“Commencement Date”) and secure a final Certificate of Compliance by June 30, 2015 (hereinafter, “Completion Date”).

The presence of an Owner’s Construction Inspector does not relieve the Contractor of any of its responsibilities for quality control and independent testing set forth in the General Requirements. The Owner’s Construction Inspector has the authority to report any deviations from the Contract Documents directly to the Contractor’s superintendent at the job site for immediate action, and also to report same to the Program Manager or Design Professional, and Owner.
