Ceiling Prices. The individual Base Equipment Price (after discount); OEM Option, Accessory, & Implement Price (after discount); and OEM Part Price (after discount) contained or referenced in the Attachment A, Price sheets, shall be the not-to-exceed Ceiling Prices under the Contract. Compliance with Laws, Rules, Codes, Ordinances, and Licensing Requirements The Contractor shall comply with all laws, rules, codes, ordinances, and licensing requirements that are applicable to the conduct of its business, including those of Federal, State, and local agencies having jurisdiction and authority. For example, Chapter 287 Florida Statutes, and Rule Chapter 60A of the Florida Administrative Code govern the contract. The Contractor shall comply with section 274A of the Immigration and Nationality Act, the Americans with Disabilities Act, and all prohibitions against discrimination on the basis of race, religion, sex, creed, national origin, handicap, marital status, or veteran’s status. Violation of any laws, rules, codes, ordinances, or licensing requirements may be grounds for contract termination or nonrenewal of the contract.

Ceiling Prices. The Representative Model Price for each Representative Model listed in the Contractor’s submitted Price Sheet (C.4), shall be the not-to-exceed Ceiling Prices under the Contract. The Options discount listed in the Contractor’s submitted Price Sheet (C.4) shall be the minimum discount applied to Options.
Ceiling Prices. The Representative Base Model Vehicle Price, individual OEM Options Net Price or OEM Options MSRP credit, and the Identified Aftermarket Option Price for each Representative Model described in the Price Sheets, shall be the not-to-exceed Ceiling Prices under the Contract.
Ceiling Prices. The individual Net Tire Prices (after the applicable GBPL Discount is applied to the approved Government Book Price) and individual Optional Related Service Prices contained or referenced in the Section 7.1, Price Sheet & Ordering Instructions, Authorized Price List, will be the not-to-exceed Ceiling Prices under the Contract. Unless stated otherwise herein, the Ceiling Prices for the Tires and Optional Related Services individually include: all profit, administrative charges / fees, Authorized Dealer preparation charges / fees, environmental charges / fees (except Waste Tire Fee, per Section 5.8), packing charges / fees, handling charges / fees, freight charges / fees, shipping charges / fees, delivery charges / fees to any point within the State of Florida, warranty charges / fees, shop charges / fees, and any other charges or fees necessary to provide the Tire or Optional Related Service according to the requirements, specifications, terms, and conditions, exclusive of taxes. Where a Ceiling Price is a Net Tire Price, the Net Tire Price shall be calculated by applying the applicable GBPL Discount from Section 7.1, Price Sheet & Ordering Instructions, to the individual Tire’s approved Government Book Price and rounding to the nearest whole cent. For example, if the applicable GBPL Discount is 50.00% and the individual Tire’s Government Book Price is $147.59, then the Net Tire Price will be $73.80 [$147.59 – 50.00% = $73.795 = $73.80 (as rounded to the nearest whole cent)]. Additionally, the Contractor may, is encouraged to, and under certain circumstances (per Section 5.9, Authorized Price List) shall be required by the Department to provide Net Down Prices for contracted Tires. A Net Down Price is where the Contractor provides a specific Tire with a price lower than the contractually required Net Tire Price (Ceiling Price). For example, if the Net Tire Price is calculated at $73.80, the Net Down Price may be provided by the Contractor at a lower price, $55.00. Net Down Prices shall not exceed the Net Tire Price (Ceiling Prices) for the respective Tires. Eligible Users may negotiate Net Tire Prices, Net Down Prices, and Optional Related Service Prices for the contracted Tires and Optional Related Services with the Contractor and Authorized Dealer, provided the negotiated prices do not exceed the Ceiling Prices for the respective Tire or Optional Related Service.   • Contingent Price Adjustment It is the policy of the State of Oregon that unprocessed timber shall not be exported from lands owned or managed by the STATE or any of its political subdivisions or agencies, in accordance with the terms of current federal law and the Constitution and the laws of the State of Oregon. PURCHASER specifically agrees that Section 1 is a material term of this contract and is part of the consideration offered to STATE in return for STATE's performance. In the event that any federal law or state constitutional provision or law or any provision of this contract concerning export of unprocessed timber is declared invalid by any court or administrative tribunal, PURCHASER agrees to pay to STATE a contingent price in the amount of the difference between the purchase price set forth in this section and the price obtained by PURCHASER for the exported unprocessed timber. The default provisions of OAR 629-032-0000 through 629-032-0070 shall not apply to exported unprocessed timber. In the event that timber made available under this contract is exported in violation of this contract, PURCHASER shall be in material breach of the contract. STATE shall be entitled to cease performance of the contract and recover, in addition to the adjusted price set out above, a further sum estimated to compensate for administrative expense and the economic impact of the violation upon the State and its citizens. In no case shall this additional amount be less than $10,000 per incident.

  • ADJUSTMENT FACTORS The Contractor will perform any or all Tasks in the Construction Task Catalog for the Unit Price appearing therein multiplied by the following Adjustment Factors. See the General Terms and Conditions for additional information.

  • Unit Prices If unit prices are stated in the Contract Documents or subsequently agreed upon, and if the quantities originally contemplated are so changed in a Change Order that application of the agreed unit prices to the quantities of work proposed will cause substantial inequity to the Owner or the Contractor, the applicable unit prices shall be equitably adjusted as provided in the Special Conditions or as agreed to by the parties and incorporated into the Change Order.
