CASHING CHECKS. If we cash a check for you that is drawn on another bank, we may withhold the availability of a corresponding amount of funds that are already in your account. Those funds will be available at the time funds from the check we cashed would have been available if you had deposited it.

You agree that we may impose conditions on persons who request us to cash a check drawn on your account (for example, by requiring payment of a fee, the presentation of appropriate identification, and/or placement of a fingerprint on the check); we may also refuse to cash the item. We (without liability) may refuse to pay a check drawn on your account presented by a payee or holder of the check for immediate payment at one of our branches if (1) we have a concern about the authority or identity of the person presenting the check, (2) our computers are not working properly, (3) the amount of the check exceeds $5000 or such other limit we may set from time to time, or (4) we, in our sole discretion, are suspicious about the transaction such as, we question the authenticity of the Item. You agree that our refusal to pay such a check is not wrongful dishonor. If the payee does not have a deposit relationship with us, we may also require a fingerprint before we pay the check, we may charge a fee for paying the check, or we may refuse to pay the check. From time to time, we may also impose other requirements that we consider appropriate. We have no liability to you for refusing to pay the check or charging a fee.

CASHING CHECKS. You should not use your account to cash checks for others who are not known to you. Although we may make funds provisionally available to you and may take steps to determine whether a check will be paid, you are responsible for any loss that occurs if the check is returned to us for any reason (e.g. because it is counterfeit or fraudulent). Our employees cannot promise that checks drawn on or issued by other institutions, including cashier’s chesks, will be paid.
