Cart Replacement. Contractor’s employees must take care to prevent damage to Carts by 964 unnecessary rough treatment. However, any Cart damaged by the Contractor must be replaced by 965 Contractor, at Contractor's expense, within five (5) Work Days at no cost or inconvenience to the Service 966 Recipient.

Cart Replacement. Any Cart damaged by the Contractor shall be replaced by the Contractor, at the Contractor's expense. If a Cart is lost, stolen or damaged beyond repair through no fault of the Contractor, the Contractor shall deliver replacement Cart to Customer by the next regularly scheduled collection day provided that the Customer notifies the Contractor two (2) Work Days in advance of the next collection day. Each Cart Customer shall be entitled to the replacement of one (1) lost, destroyed, or stolen Refuse Cart, one (1) lost, destroyed, or stolen Recycling Cart, and one (1) lost, destroyed, or stolen Organics Cart during the initial Term of this Agreement at no cost. For replacements of more than one (1) lost, destroyed, or stolen Cart of each type during the initial Term, Contractor may charge Customer the Cart replacement fee shown in Exhibit A. After the initial Term, Customers shall be entitled to one (1) additional free replacement Cart of each type during the remaining Term of this Agreement.

In addition, the Company will replace Solid Waste Carts damaged due to normal wear and tear and provide free replacements for graffiti on Solid Waste Carts without charge within 14 days of the Customer’s or City’s request. Customers will be able to make a change in Cart size or number of Carts once every twelve months at no additional replacement cost. The Company, without expense to the City or the Customer, and within five working days after notice, shall provide a Solid Waste Cart to a new Residential Customer that has no such Cart or to a new Multi-Family Customer who elects Cart service. The Company shall own and maintain all Solid Waste Carts at its expense, except as provided in this paragraph.

Cart Replacement. In the event a Customer's Solid Waste or Recyclable Materials Cart is damaged or the Customer requests a different size Cart, Franchisee will repair or replace the existing Cart no later than the Customer's next scheduled collection date after receiving notice of the damage or request for exchange. A damaged Cart that cannot be repaired may only be replaced with a new Cart or a "like-new" Cart that (a) has been in service for no more than one year, and (b) has been pressure washed and thoroughly deodorized. The monthly reports Franchisee is required to provide the City must include the number of Cart replacement requests received and filled by Franchisee, as well as the number of instances in which Cart replacement was not accomplished in the manner required by this Section 8.10.
Cart Replacement. Contractor shall replace at no charge to the Village or the individual Residential Unit any Cart that becomes damaged or destroyed during the provision of the Service, or that becomes unusable because of ordinary wear and tear. However, if a Cart in the possession of a Residential Unit is lost, stolen, damaged, or destroyed through no fault of Contractor, the occupant of the Residential Unit shall be responsible to compensate Contractor the fair market value for the replacement of such Cart. The Residential Unit shall be billed separately for such replacement cost.

If the Benchmark Replacement is Daily Simple SOFR, all interest payments will be payable on a quarterly basis.

  • Tool Replacement Personal tools worn out and/or broken on the job will be replaced on a like- for-like basis by the Employer, provided the tool is turned in to the Employer and the Employer had knowledge the tool was being used on the job. If an employee has his/her tools stolen from a state vehicle, the Employer will replace those tools, as long as no employee negligence has occurred.
