Cargo Measurement. (a) The tank gauges and devices referred to in Clause 4.1(o) shall, at the time of their selection, be reasonably satisfactory to Charterer, be accurate and reliable in their practical application and comply with the maximum permissible tolerances provided for in Schedule I. Compliance with the foregoing shall, when requested by Charterer, be verified by an internationally recognised independent marine surveyor selected by Charterer and arranged by Owner.

Cargo Measurement. (a) Prior to loading, Master shall measure the on board quantities of cargo, water and sediment residues which are segregated in all holding tanks and slop tanks and those which remain in cargo tanks and, if requested, shall advise supplier(s) and Charterer of such quantities. After loading, Master shall determine the cargo quantities loaded, expressing these cargo quantities in barrels at standard temperature (60˚F), using for such calculations the latest Manual of Petroleum Measurement Standards issued by the American Petroleum Institute (API MPMS) or similar standards issued by the American Society for Testing and Materials. A written tank-by-tank ullage report containing all measurements of oil, water and sediment residues on board prior to loading and quantities of cargo loaded shall be prepared and promptly submitted by Master to Charterer.
Cargo Measurement. All cargo measurement hereunder for the calculation of Freight or any warranties, hereunder, related to cargo or heel volumes shall be determined from the final custody transfer documentation, certifying measurements taken on board the Vessel immediately before and after cargo transfer at the Loading and Discharging Ports, as applicable. Such measurements shall be witnessed (signed) by both the Vessel and the terminal providing or receiving the cargo. Charterer may provide its own representatives to be present at any custody transfer measurement applicable to cargo carried hereunder. Custody transfer measurements shall be carried out following the recommendation of GIIGNL custody transfer handbook and in accordance with standard industry practice.
Cargo Measurement. Contractor shall ensure that the Vessel’s cargo measuring equipment, including gauges, tank ullage tables and devices for sampling temperature, level and pressure, are accurate and reliable in their practical application and comply with any applicable Laws, International Standards (as at the as-built date of the Vessel) and the maximum permissible tolerances provided for in Schedule III - Gas Measurement and Quality and shall keep all certifications of the cargo measuring equipment as required by applicable Law, International Standards and acting as a Reasonable and Prudent Operator.

A written tank-by-tank ullage report containing all measurements of oil, 1373 water and sediment residues on board prior to loading and quantities of cargo 1374 loaded shall be prepared and promptly submitted by the Master to Charterer. 1375 b Letter of Protest 1376 If the Master’s calculations of cargo loaded (oil, water and sediment residues on 1377 board excluded), after applying the Vessel’s Experience Factor ("VEF"), show 1378 any deficiency from the Bill of Lading figures, the Master shall, if investigation and 1379 recalculation verify such deficiency, issue a Letter of Protest to supplier(s) (which 1380 should, if practicable, be acknowledged) and shall immediately advise Charterer 1381 of such deficiency by electronic mail, telex or radio and thereafter shall send a 1382 copy of the Letter of Protest to Charterer. The Vessel shall have on board 1383 sufficient historical information for the calculation of a VEF using the latest edition 1384 of the API MPMS. The Master shall calculate and apply the VEF, as so 1385 determined, during all loadings. 1386 c Discharging Requirements 1387 Prior to discharging, the Master shall measure the quantity of each grade of cargo 1388 on board, expressing these quantities in barrels at standard temperature (60°F), 1389 using the same calculation procedures specified in Clause 26a. Before and after 1390 discharging, the Master shall cooperate with shore staff to ascertain discharged 1391 quantities. The Vessel shall be obliged to discharge all liquid oil and, if ordered 1392 by Xxxxxxxxx, any residues of oil, water and sediment.   • Measurement Should the State terminate this contract as herein provided, no fees other than fees due and payable at the time of termination shall thereafter be paid to the Engineer. In determining the value of the work performed by the Engineer prior to termination, the State shall be the sole judge. Compensation for work at termination will be based on a percentage of the work completed at that time.   • Stability Testing Patheon may be requested to conduct stability testing on the Products in accordance with the protocols set out in the Specifications for the separate fees and during the time periods set out in Schedule C to a Product Agreement. Patheon will not make any changes to these testing protocols without prior written approval from Client. If a confirmed stability test failure occurs, Patheon will notify Client within one Business Day, after which Patheon and Client will jointly determine the proceedings and methods to be undertaken to investigate the cause of the failure, including which party will bear the cost of the investigation. Patheon will not be liable for these costs unless it has failed to perform the Manufacturing Services in accordance with the Specifications, cGMPs, and Applicable Laws.
