Capacity Limits. The following capacity limits are established in accordance with the Kentucky Standards of safety adopted pursuant to KRS 227.300. These limits cannot be exceeded under any circumstance:
Capacity Limits. During the Term, Novo Nordisk Delivery Technologies, Inc. shall provide Aradigm with the Manufacturing capacity, which includes Device production and packaging, indicated in the chart below for each of the three (3) process groups (i.e., upstream processing; compounding/filling; and downstream processing, including handle lamination through packaging). Notwithstanding the foregoing, if Novo Nordisk Delivery Technologies, Inc. provides Aradigm with ninety (90) days prior written notice that Novo Nordisk Delivery Technologies, Inc. needs additional capacity for itself to provide Device and/or Dosage Forms for the phase 3 insulin trial that it will conduct, then Novo Nordisk Delivery Technologies, Inc. may shift the capacity allocated to Aradigm’s requirements as set forth in this Agreement as follows: (i) in 2005, Novo Nordisk Delivery Technologies, Inc. may shift the 1/6th of actual capacity to the fourth Contract Quarter of 2005 or split the 1/6th of actual capacity between the first and second half of 2005; (ii) in 2006, Novo Nordisk Delivery Technologies, Inc. may shift the 1/4 of actual capacity to either of the last 2 Contract Quarters of 2006 or split the 1/4 of actual capacity between the first and second half of 2006; and (iii) in 2007, Novo Nordisk Delivery Technologies, Inc. may shift the 1/4th of actual capacity to either of the last 2 Contract Quarters of 2007 or split the 1/4th of actual capacity between the first and second half of 2007. For the avoidance of doubt, the table below lists calendar year capacity. Therefore, in the event that this Agreement terminates before December 31, 2007, Aradigm will only have a corresponding proportional amount of capacity for that year. Contract Year Capacity for Each Unit Operation 2005 1/6th of actual capacity 2006 1/4th of actual capacity 2007 1/4th of actual capacity Notwithstanding this Section 3.1, Novo Nordisk Delivery Technologies, Inc. shall not be obligated to provide Aradigm with the Manufacturing capacity related to use of the sterile core and other filling activities, as described above, if, in its sole discretion, it concludes that the provision of such Manufacturing capacity would, in any manner, impair Novo Nordisk Delivery Technologies, Inc.’s ability to supply any capacity related to its activities under the Amended and Restated License Agreement.
Capacity Limits. The License Holder must ensure the capacity of any Designated Space is not exceeded.

On Site Car Parking is limited and conditions of use will be discussed prior to the let, if agreed, and is subject to the Site Supervisor’s control throughout the hirer. No parking is allowed in school playground at any time.
Capacity Limits. 4.1 Safe capacity of the areas designated f or letting are: STANDING SEATED Main Hall 200 or 150 Dining Hall 100 or 75 This is subject to the nature of the booking. An activity plan must be submitted upon application where necessary.
Capacity Limits. EXXONMOBIL’s maximum daily mass limits for discharge shall be based on the % of the CITY’S Maximum Allowable Industrial Load (MAIL) for selenium and arsenic in the first EXXONMOBIL permit cycle. The % shall be equivalent to 0.28 #/day of arsenic and 1.27 #/day of selenium for the first permit cycle. EXXONMOBIL acknowledges and accepts a maximum daily discharge flow set by the CITY of 2.0 million gallons per day (mgd). Each renewal of the Permit shall list and set both pounds per day (lbs/day) and/or concentration and the maximum daily discharge flow. EXXONMOBIL acknowledges that mass limits, concentration limits, and number of specific pollutants shall either remain the same, increase, or decrease with each renewal of the Industrial Discharge Permit as determined by the CITY. EXXONMOBIL may request a variance to the daily maximum flow rate of 2.0 MGD in the event that it anticipates the flow limit might be exceeded. The variance shall be requested forty-eight (48) hours prior to the day on which the flow is expected to

Capacity Limits. 1. Southborough's obligation to supply water under this Agreement is contingent on the MWRA supplying Southborough with water flows sufficient to meet the needs of both Parties.
Capacity Limits. The rights granted in this section 2 regarding the Swimming Pool and Tennis Court are on a first come/first served basis and are subject to the capacity limits of these facilities.
