Common use of Capacity Interconnection Rights Clause in Contracts

Capacity Interconnection Rights. Pursuant to and subject to the applicable terms of the Tariff, the Interconnection Customer shall have Capacity Interconnection Rights at the Point(s) of Interconnection specified in this Interconnection Service Agreement in the amount of 67.3 MW commencing June 1, 2022. From the effective date of this ISA until May 31, 2022 (the “interim time period”), in addition to the 32.8 MW of Capacity Interconnection Rights the Interconnection Customer will have commencing June 1, 2021 at the same Point of Interconnection associated with the AD2-160 Interconnection Request, the Interconnection Customer also may be awarded interim Capacity Interconnection Rights in an amount not to exceed 34.5 MW associated with the AE2-253 Interconnection Request. Accordingly, during the interim time period, the Interconnection Customer shall have 34.5 MW of Capacity Interconnection Rights and may be awarded interim Capacity Interconnection Rights in an amount not to exceed 34.5 MW. The availability and amount of such interim Capacity Interconnection Rights shall be dependent upon completion and results of an interim deliverability study. Any interim Capacity Interconnection Rights awarded during the interim time period shall terminate on May 31, 2022.

Capacity Interconnection Rights. From the effective date of this ISA until May 31, 2022 (the “interim time period”), in addition to the 32.8 152.3 MW of Capacity Interconnection Rights the Interconnection Customer will have commencing June 1, 2021 had at the same Point of Interconnection prior to its Interconnection Request associated with the AD2-160 Interconnection Requestthis ISA, the Interconnection Customer also may be awarded interim Capacity Interconnection Rights in an amount not to exceed 34.5 MW associated with the AE2-253 Interconnection Request17.7 MW. Accordingly, during the interim time period, the Interconnection Customer shall have 34.5 152.3 MW of previously awarded Capacity Interconnection Rights and may be awarded interim Capacity Interconnection Rights in an amount not to exceed 34.5 17.7 MW. The availability and amount of such interim Capacity Interconnection Rights shall be dependent upon completion and results of an interim deliverability study. Any interim Capacity Interconnection Rights awarded during the interim time period shall terminate on May 31, 2022.

Accordingly, during the interim time period, the Interconnection Customer shall have 34.5 57 MW of previously awarded Capacity Interconnection Rights and may be awarded interim Capacity Interconnection Rights in an amount not to exceed 34.5 5 MW. The availability and amount of such interim Capacity Interconnection Rights shall be dependent upon completion and results of an interim deliverability study. Any interim Capacity Interconnection Rights awarded during the interim time period shall terminate on May 31, 20222023.

Accordingly, during the interim time period, the Interconnection Customer shall have 34.5 19.6 MW of previously awarded Capacity Interconnection Rights and may be awarded interim Capacity Interconnection Rights in an amount not to exceed 34.5 1 MW. Accordingly, during the interim time period, the Interconnection Customer shall have 34.5 5.13 MW of previously awarded Capacity Interconnection Rights and may be awarded interim Capacity Interconnection Rights in an amount not to exceed 34.5 3.9 MW. The availability and amount of such interim Capacity Interconnection Rights shall be dependent upon completion and results of an interim deliverability study. Any interim Capacity Interconnection Rights awarded during the interim time period shall terminate on May 31, 20222023.

Capacity Interconnection Rights. Pursuant to and subject to the applicable terms of the Tariff, the Interconnection Customer shall have Capacity Interconnection Rights at the Point(s) of Interconnection specified in this Interconnection Service Agreement in the amount of 67.3 1,650 MW.1836 MW commencing June 1, 2022. 2021 as follows: Generator Capacity Interconnection Rights Unit #1 612 MW Unit #2 612 MW Unit #3 612 MW From the effective date of this ISA until May 31, 2022 2021 (the “interim time period”), in addition to the 32.8 1650 MW of Capacity Interconnection Rights the Interconnection Customer will have commencing June 1, 2021 had at the same Point of Interconnection prior to its Interconnection Request associated with the AD2-160 Interconnection Requestthis ISA, the Interconnection Customer also may be awarded interim Capacity Interconnection Rights in an amount not to exceed 34.5 MW associated with the AE2-253 Interconnection Request186 MW. Accordingly, during the interim time period, the Interconnection Customer shall have 34.5 1650 MW of previously awarded Capacity Interconnection Rights and may be awarded interim Capacity Interconnection Rights in an amount not to exceed 34.5 186 MW. The availability and amount of such interim Capacity Interconnection Rights shall be dependent upon completion and results of an interim deliverability study. Any interim Capacity Interconnection Rights awarded during the interim time period shall terminate on May 31, 20222021.

Accordingly, during the interim time period, the Interconnection Customer shall have 34.5 88 MW of previously awarded Capacity Interconnection Rights and may be awarded interim Capacity Interconnection Rights in an amount not to exceed 34.5 8 MW. The availability and amount of such interim Capacity Interconnection Rights shall be dependent upon completion and results of an interim deliverability study. Any interim Capacity Interconnection Rights awarded during the interim time period shall terminate on May 31, 20222023.

Accordingly, during the interim time period, the Interconnection Customer shall have 34.5 19.5 MW of previously awarded Capacity Interconnection Rights and may be awarded interim Capacity Interconnection Rights in an amount not to exceed 34.5 1 MW. The availability and amount of such interim Capacity Interconnection Rights shall be dependent upon completion and results of an interim deliverability study. From During the time period from the effective date of this ISA until May 31, 2022 2020 (the “interim time period”), in addition to the 32.8 3.8 MW of Capacity Interconnection Rights the Interconnection Customer will have commencing June 1, 2021 had at the same Point of Interconnection prior to its Interconnection Request associated with the AD2-160 Interconnection Requestthis ISA, the Interconnection Customer also may be awarded interim Capacity Interconnection Rights in an amount not to exceed 34.5 MW associated with the AE2-253 Interconnection Request3.8 MW. Accordingly, during the interim time period, the Interconnection Customer shall have 34.5 3.8 MW of previously awarded Capacity Interconnection Rights and may be awarded interim Capacity Interconnection Rights in an amount not to exceed 34.5 3.8 MW. The availability and amount of such interim Capacity Interconnection Rights shall be dependent upon completion and results of an interim deliverability study. Any interim Capacity Interconnection Rights awarded during the interim time period shall terminate on May 31, 20222020.

From the effective date of this ISA until May 31, 2022 2023 (the “interim time period”), in addition to the 32.8 24.6 MW of Capacity Interconnection Rights the Interconnection Customer will have commencing June 1, 2021 had at the same Point of Interconnection prior to its Interconnection Request associated with the AD2-160 Interconnection Requestthis ISA, the Interconnection Customer also may be awarded interim Capacity Interconnection Rights in an amount not to exceed 34.5 MW associated with the AE2-253 Interconnection Request1.5 MW. Accordingly, during the interim time period, the Interconnection Customer shall have 34.5 24.6 MW of previously awarded Capacity Interconnection Rights and may be awarded interim Capacity Interconnection Rights in an amount not to exceed 34.5 1.5 MW. The availability and amount of such interim Capacity Interconnection Rights shall be dependent upon completion and results of an interim deliverability study. Any interim Capacity Interconnection Rights awarded during the interim time period shall terminate on May 31, 20222023.

From the effective date of this ISA until May 31, 2022 2021 (the “interim time period”), in addition to the 32.8 88 MW of Capacity Interconnection Rights the Interconnection Customer will have commencing June 1, 2021 had at the same Point of Interconnection prior to its Interconnection Request associated with the AD2-160 Interconnection Requestthis ISA, the Interconnection Customer also may be awarded interim Capacity Interconnection Rights in an amount not to exceed 34.5 MW associated with the AE2-253 Interconnection Request12 MW. Accordingly, during the interim time period, the Interconnection Customer shall have 34.5 88 MW of previously awarded Capacity Interconnection Rights and may be awarded interim Capacity Interconnection Rights in an amount not to exceed 34.5 12 MW. The availability and amount of such interim Capacity Interconnection Rights shall be dependent upon completion and results of an interim deliverability study. Any interim Capacity Interconnection Rights awarded during the interim time period shall terminate on May 31, 20222021.

From the effective date of this ISA until May 31, 2022 2023 (the “interim time period”), in addition to the 32.8 288 MW of Capacity Interconnection Rights the Interconnection Customer will have commencing June 1, 2021 had at the same Point of Interconnection prior to its Interconnection Request associated with the AD2-160 Interconnection Requestthis ISA, the Interconnection Customer also may be awarded interim Capacity Interconnection Rights in an amount not to exceed 34.5 MW associated with the AE2-253 Interconnection Request14.5 MW. Accordingly, during the interim time period, the Interconnection Customer shall have 34.5 288 MW of previously awarded Capacity Interconnection Rights and may be awarded interim Capacity Interconnection Rights in an amount not to exceed 34.5 14.5 MW. The availability and amount of such interim Capacity Interconnection Rights shall be dependent upon completion and results of an interim deliverability study. Any interim Capacity Interconnection Rights awarded during the interim time period shall terminate on May 31, 20222023.
