California Department of Fish and Game. DFG is the agency of the State of California authorized to act as trustee for wildlife (as defined in Fish and Game Code section 1802) for the State on behalf of its residents. DFG is authorized to approve NCCPs pursuant to the NCCPA, administer and enforce CESA and other provisions of the Fish and Game Code and regulations adopted pursuant to the Fish and Game Code, and enter into agreements with federal and local governments and other entities for the conservation of species and habitats pursuant to CESA and the NCCPA.

California Department of Fish and Game. DFG is the agency of the State of California authorized to act as trustee for the state’s wildlife, designated rare and endangered plants, game refuges, ecological reserves, and other areas administered by the Department. DFG also administers and enforces the provisions of the Fish and Game Code and is authorized to enter into agreements with federal and local governments and other entities for the conservation of species and habitats. DFG may authorize, pursuant to the CESA, the Take of species listed as threatened or endangered which is incidental to an otherwise lawful activity. DFG may also permit such Take and provide regulatory assurances under the NCCPA for identified species whose conservation and management is provided for in a DFG- approved NCCP. During the planning process for the DRECP, the DFG will, among other things: • Attend all relevant REAT operational meetings and all REAT managers’ meetings; • Provide field- and state-level data and information to support the development of the DRECP; • Attend meetings with local partners and agencies, presenting information as necessary; • Advise State agencies and local entities on measures necessary to comply with the NPPA and other relevant laws; and • Work with the CEC and the federal REAT Partners, leading the development of the biological portions of the DRECP, establishing a conservation strategy, and arranging for independent science input.

Task 5: Enlarge Culvert Subtask 5a Conduct Land Surveys: Stetson will conduct land surveys around the culvert before the final design drawings and specifications are developed. Subtask 5b Prepare Bid Package: Based on comments received during the permitting process, Stetson will prepare 80% design drawings and specifications for review and comment. Upon receipt of review comments from Marin County Flood Control District for the 80% design, Stetson will finalize the design and prepare a complete bid package for construction. Bid documents will include signed and sealed engineered drawings, contract specifications per County Standards and technical specifications sufficient to bid and construct the proposed final design. An engineer’s estimate of probable cost will be prepared based on the final design. Subtask 5c Support Construction. Xxxxxxx will support the bidding process by attending a pre-bid meeting, preparing response to questions, attending a public bid opening, reviewing bids and preparing a due diligence memo reviewing the contractors who submitted the three lowest bids. Once a contract is awarded, Xxxxxxx will attend a pre-construction meeting, review material submittals and show drawings. Stetson will administer the construction contract including reviewing pay quantities. Subtask 5d Install Culvert. Construction of the culvert involves salvaging plants from the area to be disturbed, installing cofferdams to xxxxxxx the work area, removing the old culvert, installing the new culvert, restoring the path, and installing erosion control. At key times during construction, as spot checks and as issues arise, Xxxxxxx will inspect the contractors work for compliance with the design. Subtask 5e Compliance Monitoring: A xxxxxxx rail biologist will be present during installation of cofferdams around the work area, but once the area is dewatered, no xxxxxxx rail monitoring will be necessary.

  • HEALTH, SAFETY AND ENVIRONMENT 41.1 In the performance of this Contract, Contractor and Operator shall conduct Petroleum Operations with due regard to health, safety and the protection of the environment (“HSE”) and the conservation of natural resources, and shall in particular:

  • ENVIRONMENT, SAFETY AND HEALTH PROTECTION (a) Seller shall perform this Agreement in a manner that ensures adequate protection for workers, the public, and the environment, and shall be accountable for actions of itself and its lower-tier subcontractors, agents and employees. Seller shall exercise a degree of care commensurate with the work and the associated hazards. Seller shall ensure that management of environment, safety and health (ES&H) functions and activities is an integral and visible part of Seller’s work planning and execution process. In the event that Xxxxxx fails to comply with this Agreement, Company may, without prejudice to any other legal or contractual rights, issue an order stopping all or any part of the work; thereafter a start order for resumption of work may be issued at Company’s discretion. Seller shall make no claim for an extension of time or for compensation or damages by reason of or in connection with such work stoppage. In addition, Company may require, in writing, that Seller remove from the work any employee the Company deems unsafe, incompetent, careless, or otherwise objectionable.

  • California Labor Code Compliance a. Prevailing Wage laws apply, Subrecipient hereby agrees to pay, or cause its subcontractors to pay, Prevailing Wage rates at all times for all construction, improvements, or modifications to be completed for County under this Contract. Subrecipient herein agrees that Subrecipient shall post, or cause to be posted, a copy of the most current, applicable Prevailing Wage rates at the site where the construction, improvements, or modifications are performed.

  • ENVIRONMENTAL PROTECTION STANDARDS CONTRACTOR shall be in compliance with the Clean Air Act (Title 42 USC Section 7401 et seq.), the Clean Water Act (Title 33 USC Section 1251 et seq.), Executive Order 11738 and Environmental Protection Agency, hereinafter referred to as “EPA,” regulations (Title 40 CFR), as any may now exist or be hereafter amended. Under these laws and regulations, CONTRACTOR assures that:

Contractor shall conduct operations under this Contract so as to assure that pollutants do not enter municipal storm drain systems which systems are comprised of, but are not limited to curbs and gutters that are part of the street systems ("Stormwater Drainage System"), and to ensure that pollutants do not directly impact "Receiving Waters" (as used herein, Receiving Waters include, but are not limited to, rivers, creeks, streams, estuaries, lakes, harbors, bays and oceans).

The District shall protect certificated employees acting within the scope of their employment by purchasing liability insurance in the amount of at least five million dollars ($5,000,000) per occurrence, and the District shall include the certificated employees as named insured under the liability insurance and errors and omissions policy of the school district.
