BUYER-FURNISHED PROPERTY. Seller shall not disclose to any third party, or use, reproduce, or appropriate any material, tooling, drawing, designs, and other property or data furnished by Buyer (“Buyer-Furnished Property”), nor will Seller use the same to produce, manufacture or provide more of the Work than is required hereunder. All Buyer-Furnished Property is being provided for use on an “as-is” basis, and Buyer makes no representations or warranties with respect thereto, whether express or implied. Title to Buyer-Furnished Property will remain with Buyer at all times. Buyer has no obligation to furnish any Buyer-Furnished Property, and Seller is solely responsible for obtaining and maintaining the tools and equipment necessary for the fulfillment of its obligations hereunder, including all repair and replacement costs associated therewith. Seller will bear the risk of loss or damage to all Buyer-Furnished Property unless such loss or damage is solely, directly, and proximately caused by Buyer. All Buyer-Furnished Property, together with spoiled and surplus materials, must be returned to Buyer at termination or completion of this Agreement or upon Buyer’s demand, whichever occurs first, unless Buyer otherwise directs. All designs, sketches, patterns, tools, equipment, special appliances, software, plans, documents, models, interfaces, data, and configurations (“Equipment”) paid for directly or indirectly (including as part of the purchase price, whether or not specifically itemized) by Buyer are Buyer-Furnished Property and subject to the terms of this Section. Any Equipment purchased, furnished, or used by Seller in its performance of its obligations under this Agreement that does not become Buyer-Furnished Property under this Section is subject to Buyer’s option, at any time and from time to time, to purchase from Seller some or all of such Equipment, and upon the exercise of such option Buyer will become the owner and entitled to possession of the same. The purchase price for such Equipment may not exceed to the initial cost of such Equipment less any accumulated depreciation. Seller shall not sell or otherwise dispose of any such Equipment without the prior written consent of Buyer.

BUYER-FURNISHED PROPERTY. All tools or other materials furnished by the Buyer for the use in the performance of this order shall remain the property of the Buyer (or of the Government, as the case may be), shall be used by the Seller in the performance of this order only, in accordance with the requirements of the order relating to such use, and shall be returned to the Buyer when requested upon completion or termination of the order to the extent not previously delivered to the Buyer. Seller agrees to exercise reasonable care in the safeguarding and exercise reasonable care in the safeguard and preservation of all Buyer-furnished property and assumes all responsibility for loss, damage or destruction while such property is within its possession or control.
BUYER-FURNISHED PROPERTY. Buyer may, by written notice, provide to Seller property owned by either Buyer or its customer (“Furnished Property”). Furnished Property shall be used only for performance under this Order. Title to Furnished Property shall remain with Buyer or its customer as applicable. Seller shall clearly xxxx (if not so marked) all Furnished Property to show its ownership. Except for reasonable wear and tear, Seller shall be responsible for, and shall promptly notify Buyer of, any loss or damage to Furnished Property. Without additional charge, Seller shall manage, maintain, and preserve Furnished Property in accordance with applicable law, the requirements of this Order and good commercial practice. At Seller's request, and/or upon completion of this Contract, Seller shall submit, in an acceptable form, inventory lists of Furnished Property and shall deliver or make such other disposal as may be directed by Buyer. Seller shall not scrap any Furnished Property without written consent. Any Buyer Furnished Property shall be subject to the terms of QCF- 106-15 Supplier Tooling Loan Agreement located at xxxx://xxx.xxxxx.xxx/ontic-resources.
BUYER-FURNISHED PROPERTY. (a) Buyer may, by written authorization, provide to Seller property owned by either Buyer or its customer (Furnished Property). Furnished Property shall be used only for performance under this PO.
BUYER-FURNISHED PROPERTY. The following additional provisions shall, unless specifically otherwise agreed in writing, apply with respect to any and all tools, equipment, material or other property used in the manufacture of products for Buyer which, whether or not listed in this order, are supplied to Seller by Buyer or are specifically paid for by Buyer. All such property is referred to herein as Buyer-furnished property.
BUYER-FURNISHED PROPERTY. Buyer may, from time to time, furnish property to Seller for performance of a Contract. Unless otherwise provided in the Contract or agreed to in writing, property of every description including all tools, molds, equipment and material furnished or made available to Seller, title to which is in Buyer, and any replacement thereof shall be and remain the property of Buyer and Seller shall indemnify and save harmless Buyer from all liens and claims against said property arising from any cause. Property other than material shall not be modified without the written consent of the Buyer. Such property shall be plainly marked or otherwise adequately identified by Seller as property of Buyer (by name) and shall be safely stored separately and apart from Seller’s property. Seller shall not use such property except for performance of work hereunder or as authorized in writing by Xxxxx. Such property while in Seller’s possession or control shall be kept in good condition, shall be held at Seller’s risk, and shall be kept insured by Seller, at its expense in an amount equal to the replacement cost with loss payable to Buyer. To the extent such property is not material consumed in the performance of this Contract, it shall be subject to inspection and removal by Buyer, and Buyer shall have the right of entry for such purposes without any additional liability whatsoever to Seller. As and when directed by Xxxxx, Seller shall disclose the location of such property and/or prepare it for shipment and ship ICC Incoterms – EX-Works its plant to Buyer (or Buyer designated location) in same condition as originally received by Seller, reasonable wear and tear excepted. Buyer may at any time reimburse Seller for the cost of part or allspecial tooling and special test equipment paid for by Seller and, upon payment therefore, Buyer shall become the owner, entitled to possession at the completion of the Contract or such earlier date as the parties may agree.
BUYER-FURNISHED PROPERTY. If in connection with the performance of this purchase order ,any property is furnished to Seller by Buyer, Seller shall assume the risk of, and be responsible for, any loss destruction of or damage to the property while in Seller's possession or control, except to the extent that this purchase order, with the prior approval of Buyer, provides for relief of Seller from such liability. In the absence of such approval Seller shall return all such property in as good a condition as when received, except for reasonable wear and tear caused by the utilization of such property in accordance with the provisions of this purchase order. Buyer shall have the right to enter Seller's premises during normal working hours to inspect its property. Seller shall maintain all Buyer furnished property at Seller's expense. Seller shall institute or have in place a property control system approved by Buyer.
