As the renter or representative of the rental organization, I have read, understand and agree to abide by all regulations set forth by the attached Xxxxx Xxxxxx Xxxxxxxx Center for Dance Building Use and Regulations. I understand that failure to abide by these regulations will result in my immediate dismissal from the premises, non-renewal of future contracts, loss of a portion or the entire security deposit, and I will be required to pay for any damages or cleanup incurred from any act or omission of any person brought into the building in connection with my rental and use of the theatre and/or studios.

LIABILITY/INDEMNIFICATION Disclosure: The University of Utah is implementing new policy concerning minors on campus. Additional information may be required to be incompliance with Utah State law. Renter must disclose all potential liability issues including nudity, adult content, and the use of any potentially dangerous props or other equipment at the time of the signing of the contract. Xxxxxx agrees to defend, indemnify, and hold harmless the University, its agents or employees from any and all injury, damage, or loss to persons or property that results from or is in any way co nnected with the use of University property by the renter or renter’s agents, guests, invitees, volunteers, performers, employees, providers, contractors and subcontractors, except where such injury, damage or loss is caused by the sole negligence of the University. It must als o include a sexual abuse and minor rider. Further, the renter agrees to provide a certificate of insurance for Commercial General Liability insurance in the amount of at least $1,000,000 per occurrence that lists the University of Utah as an additional insured. Renter may also be required to provide evidence of other insurance coverage that is reasonable based on renter’s operations. The insurance provisions herein may only be waived by the School of Dance in consultation with the University Risk and Insurance Manager. The indemnification obligations of this paragraph shall survive termination of this Agreement. Xxxxxx agrees to obtain a copy of the signed liability waiver as provided on page 6 from ALL participants including volunteers, instructors and staff. BUILDING PERIMETER. 1. Exterior parking areas, vehicle driveways, pedestrian walks, and the Building perimeter lighting levels shall be designed per Illuminating Engineering Society (IES) standards. Provide 5 foot-candles for doorway areas, 3 foot-candles for transition areas and at least 5 foot-candles throughout the parking lot. Parking lot fixtures shall provide a maximum to minimum uniformity ratio of 10:1.

Neither the University of Utah nor Department of Modern Dance is responsible for renter cancellations due to weather, lack of participation, nor any other reason(s). Rental charges will still be made if the rental is not cancelled on or before 3 working days of the date(s) requested. If the MCD facilities are closed by the University of Utah for any reason, a full refund will be given, no other compensation or consideration will be made.
