Bringing Products to Market More Quickly. The P2 Framework affords a reliable, inexpensive, and rapid way of evaluating environmental risks presented by product alternatives before product development begins. By screening out potentially hazardous materials early, PPG will greatly increase the probability that product development efforts will proceed efficiently, yielding an “environmentally-preferable” product at significantly reduced cost. Anticipating EPA concerns will allow PPG to engineer environmentally preferable products and to generate needed data in a timely manner. This in turn allows PPG to get to market as soon as possible, resulting in an increased market share. If this proposal is implemented, PPG will gain the ability to manufacture new chemical substances soon after the regulatory decision is made, and eliminate a portion of the waiting period during which EPA performs no further evaluation on low risk products.

By screening out potentially hazardous materials early, Kodak will greatly increase the probability that product development efforts will proceed efficiently, yielding an environmentally preferable product at significantly reduced cost. Anticipating EPA concerns will allow Kodak to engineer environmentally preferable products and generate needed data in a timely manner. Anticipating and addressing EPA concerns optimizes the regulatory review process and greatly decreases the probability of adverse regulatory action. This in turn allows Kodak to get to market as soon as possible, resulting in increased market share. Through the implementation of this Agreement, Kodak will gain the ability to manufacture or import new chemicals soon after the regulatory decision is made, and eliminate a portion of the waiting period during which EPA performs no further evaluation. Improving the Flow of the Innovative Process: While one of the benefits of the project to Kodak is allowing the company to bring products to market more quickly, an even more critical benefit to the company lies in its ability to innovate. Kodak typically identifies a number of new chemical alternatives that hold the promise of improving the utility or effectiveness of its products. The challenge is to bring these improvements to the marketplace quickly to test and evaluate the new product. Submitting a PMN to EPA is a fundamental part of the innovation process. The 90 day PMN clock has the effect of temporarily halting the continuous process of improvement. Kodak cannot determine if its innovations have practical application until it has the opportunity to test and evaluate these innovations in the market place. A decrease in the PMN review period from 90 to 45 days has the effect of reducing the constant “start/stop” impact on innovation that the delay causes. Reducing the review time will facilitate innovation and reduce down- time.

  • Required Procurement Procedures for Obtaining Goods and Services The Grantee shall provide maximum open competition when procuring goods and services related to the grant-assisted project in accordance with Section 287.057, Florida Statutes.

  • Infringing Products or Services If the use of any Products or Services is enjoined (collectively, “Infringing Products”), Supplier shall at its expense procure the right for DXC to continue using or receiving the Infringing Products. If Supplier is unable to do so, Supplier shall at its expense (and at Indemnitees’ option): (i) replace the Infringing Products with non-infringing Products or Services of equivalent form, function and performance; or (ii) modify the Infringing Products to be non-infringing without detracting from form, function or performance; or

  • RE-WEIGHING PRODUCT Deliveries are subject to re- weighing at the point of destination by the Authorized User. If shrinkage occurs which exceeds that normally allowable in the trade, the Authorized User shall have the option to require delivery of the difference in quantity or to reduce the payment accordingly. Such option shall be exercised in writing by the Authorized User.

  • Additional Products and Services Subject to the allocation of funds, the CPO may add similar equipment, supplies, services, or locations, within the scope of this Agreement, to the list of equipment, supplies, services, or locations to be performed or provided by giving written notification to Contractor. For purposes of this Section, the “Effective Date” means the date specified in the notification from the CPO. As of the Effective Date, each item added is subject to this Agreement, as if it had originally been a part, but the charge for each item starts to accrue only on the Effective Date.   • Scaling Lost Products The volume of lost products shall be determined by the best methods currently available, using data from the records for the period in which the loss occurred or the most applicable period if loss should occur substantially after cutting. In the absence of specific information indicating size or species of lost products, species distribution and volume for entire truckloads shall be assumed to be the same as the average volume Scaled per truck during the report period, and for individual products it shall be assumed that the volume and species were the average volume of the highest priced species Scaled during the report period. B6.851 Scaling Lost Sample Loads. If Scal- ing is being done by sampling loads of logs, Purchaser shall present such sample loads for Scaling by Forest Service. If loads of logs selected to be sample Scaled are placed in the decks before they are Scaled, they will be considered as lost sample loads. It will be difficult, if not impossible, to determine the volume and species con- tained in such loads for payment purposes. Therefore, lost sample loads will be deemed to have a Scale volume and species composition equal to that of the highest value load Scaled during the sampling period, as estab- lished by Forest Service. If no sample loads were Scaled during the period, the Scale data for the high valued load will be taken from the most current preceding sampling period with Scale. Sample loads lost as a result of Forest Service actions shall be treated as non-Scaled loads.

  • Loss Leader; Recycled Products Contractor shall not sell or use any article or product as a “loss leader” as defined in Section 17030 of the Business and Professions Code. If Contractor will sell to the Judicial Council, or use in the performance of this Agreement, goods specified in PCC 12207 (for example, certain paper products, office supplies, mulch, glass products, lubricating oils, plastic products, paint, antifreeze, tires and tire-derived products, and metal products), then with respect to those goods: (i) Contractor shall use recycled products in the performance of this Agreement to the maximum extent doing so is economically feasible, and (ii) upon request, Contractor shall certify in writing under penalty of perjury, the minimum, if not exact, percentage of post consumer material as defined in the PCC 12200, in such goods regardless of whether the goods meet the requirements of PCC 12209.

  • Third Party Products and Services Through its Product(s), Palo Alto Networks may make available to you third-party products or services (“third-party apps”) which contain features designed to interoperate with our Products. To use such features, you must either obtain access to such third-party apps from their respective providers or permit Palo Alto Networks to obtain access on your behalf. All third-party apps are optional and if you choose to utilize such third-party apps:

  • Product Changes Vocera shall have the right, in its absolute discretion, without liability to End User, to update to provide new functionality or otherwise change the design of any Product or to discontinue the manufacture or sale of any Product. Vocera shall notify End User at least 90 days prior to the delivery of any Product which incorporates a change that adversely affects form, fit or function (“Material Change”). Vocera shall also notify End User at least 90 days prior to the discontinuance of manufacture of any Product. Notification will be made as soon as reasonably practical for changes associated with regulatory or health and safety issues.

  • Discontinued Products If a product or model is discontinued by the manufacturer, Contractor may substitute a new product or model if the replacement product meets or exceeds the specifications and performance of the discontinued model and if the discount is the same or greater than the discontinued model.
