Breaks and Lunch Periods. Breaks will be in accordance with the following schedule and shall be scheduled by the immediate supervisor. Break periods shall be taken without loss of pay at a location to be determined by the immediate supervisor. There shall be a fifteen minute break during the first half of each employee’s shift provided the employee’s scheduled workday exceeds four hours and there shall be a fifteen minute break during the second half of each employee’s shift provided the scheduled workday exceeds seven hours. The break period shall be taken as near as possible to the middle of the four (4) hour period. Any deviation from this schedule will require verbal authorization from a supervisor. No employee shall be required to work more than five hours without a meal period which shall be a minimum of an unpaid one-half hour.
Breaks and Lunch Periods. 1. Employees who work at least 6.5 hours in a day at a Board location shall be permitted to take no more than two five-minute breaks in the a.m. and two five-minute breaks in the p.m. or one ten-minute break in the a.m. and one ten-minute break in the p.m. Breaks must be scheduled subject to operational needs, as determined by the employee's Supervisor and may be denied or cut short by the employee's Supervisor, as dictated by operational needs. Breaks may not be used to extend a lunch period or to leave early at the end of the day. 2. For purposes of this Article, a "break" is defined as any and all times when an employee is not at his/her work area performing job-related duties (except for use of the restroom and lunch time). An employee's work area includes his/her desk, areas in the buildings where the employee performs job-related duties, and areas in the community where the employee performs job-related duties. When employees are not on break, they shall be expected to be performing job-related duties. Employee use of personal cell phones during their breaks or at any other times is addressed in section 14 (Job Descriptions/Work Rules) of this agreement. 3. Employees will be accorded, except in cases of emergency, thirty (30) minutes of lunch time each day they work at a Board location. Employees shall normally have a duty-free lunch. If a non-overtime exempt employee works through a scheduled lunch at a Board location and does not receive the half-hour off at another time during the week, then he/she shall be paid or granted compensatory time for the time worked. Each employee’s lunch schedule shall be established after consultation between the employee and his/her Supervisor, including the employee’s schedule for days on which the employee will be at a special activity for individuals (e.g., field trip, holiday program, summer picnic) over lunch. The Supervisor shall have final approval of such schedule. Employees may request variations in the established lunch schedule, which must be approved in advance by the Supervisor. Without such prior approval from the Supervisor, employees may not work through lunch and take the one-half (1/2) hour at another time. The salary of overtime-exempt employees shall not be affected by whether or not the employee takes a lunch break. For non-overtime- exempt employees, time spent on lunch break and not working shall be unpaid.

After clearing their desk and shared supplies, students will be dismissed from their first class of the day and move to their second class for their break. Staff may eat lunch on campus in their own classroom or outside. If eating lunch with other staff members, all employees must be six feet apart and replace their masks when they are done

For the normal work week, overtime breaks shall be granted as follows. One ten minute break at the end of the regular shift if required to work a ten-hour shift, and a ten minute break every two hours thereafter.

Breaks and Lunch Periods. Employees working a forty (40) or forty- two (42) hour work week shall be entitled to a fifteen (15) minute break period at or near the midpoint of the first half of their shift and a fifteen (15) minute break period at or near the midpoint of the second half of their shift, except employees working twelve (12) hour shifts, who shall be entitled to a twenty (20) minute break period at or near the midpoint of the first half of their shift and a twenty (20) minute break period at or near the midpoint of the second half of their shift. (During such breaks, the employees must remain in radio contact and respond immediately to emergency calls, and at the end of the break to non-emergency calls). Employees working a forty (40) or forty-two (42) hour work week shall be entitled to a thirty (30) minute paid lunch period at or near the midpoint of their shift, except all twelve (12) hour employees shall be entitled to a forty (40) minute paid lunch period at or near the midpoint of their shift. The timing of such breaks and lunch period shall be arranged by the immediate supervisor of station personnel. All field personnel shall take their breaks and lunch periods as scheduled and approved by the Dispatcher. It is understood and agreed that the timing of the break and lunch period may vary depending on the nature of the work being performed by the employee at the time, it being recognized that under certain conditions it will be impossible for an employee to take a break period until the urgent aspect of an assignment has been completed. (a) Employees working a four (4) hour shift are entitled to a fifteen (15) minute break period at or near the midpoint of their shift. No backfill will be required for such employees during these break periods. If an employee works two (2) consecutive four (4) hour shifts, these fifteen minute break periods at or near the midpoint of the four (4) hour shifts are the only break periods to which the employee is entitled. When possible, and when it does not cause additional overtime, CSO’s are permitted to take both fifteen (15) minute breaks back to back, for a 30 minute break.

Lunch periods shall be granted, when practicable, at approximately the midpoint of the work shift. 2. Employees working seven (7) hours or more per day shall be entitled to two (2) fifteen (15) minute breaks. 5. Insofar as practical, breaks shall be scheduled in the middle of the work period. 6. If a recess period falls within an instructional assistant’s work period, the assistant will be granted the appropriate break, if any, during a part of that recess.
