BREACH OF CONTRACT ON THE PART. OF THE CUSTOMER‌ There is breach of contract on the part of the Customer if the Customer fails to perform its duties under the Agreement. In the event of late payment, the Contractor shall be entitled to late payment interest pursuant to clause 3.3. Nevertheless, there is no breach of contract if the situation is caused by circumstances related to the Contractor or by force majeure. The Contractor shall give written notice without undue delay after the breach of contract has been discovered or ought to have been discovered.
