Boundary Survey. The Administrative Agent shall have a boundary survey of the Land as of a date not more than thirty (30) days prior to the Closing Date certified by a registered engineer or land surveyor. To the extent necessary to permit the issuance of title insurance without exception for matters of survey, such survey shall be accompanied by an affidavit (a "Survey Affidavit") of the Management Company, on behalf of the Borrower, in form and substance satisfactory to the Administrative Agent. Such survey shall show the area of the Land, all boundaries of the Land with courses and distances indicated, including chord bearings and arc and chord distances for all curves, and shall show dimensions and locations of all easements, private drives, roadways, and other facts materially affecting the Land, and shall show such other details as the Administrative Agent may reasonably request, including, without limitation, any encroachment (and the extent thereof in feet and inches) onto the Land or by any of the improvements on the property upon adjoining land or upon any easement burdening the Land; any improvements, to the extent constructed, and the relation of the improvements by distances to the boundaries of the Land, to any easements burdening the Land, and to the established building lines and the street lines; and if improvements are existing, (A) a statement of the number of each type of parking space required by applicable laws, ordinances, orders, rules, regulations, restrictive covenants and easements affecting the improvements, and the number of each such type of parking space provided, and (B) the location of all utilities serving the improvements.
Boundary Survey. Lender shall have received in a form satisfactory to Lender, a boundary survey of the real estate certified to Lender and the Title Company issuing the title insurance, dated a date reasonably satisfactory to each of Lender and the Title Company by an independent professional licensed land surveyor, which boundary survey is sufficient to delete any standard printed survey exception contained in the title insurance policy.

Description: Xxxxxx & Xxxx will complete a boundary survey of the proposed property including the following items. • Establish the boundary of the property based on the legal description provided by the client. • Survey markers will be found and verified or placed on the exterior boundary of the site • File Government Section Corner Certificates on all the required corners with the County Recorder • Survey map will detail the evaluated evidence and results of the survey; survey map will also display any other potential encroachments to/from the property that were physically observed • Establish existing right-of-way limits based on the field monumentation, observed prescriptive easement limits, and title reports provided by the County.

Boundary Survey. Prior to the Possession Date, Tenant may, at Tenant’s expense, obtain a boundary survey of the Leased Premises. Such survey shall be prepared to the standards for an Indiana Land Title Association Minimum Standard Detail Survey and shall certify as to whether any portion of the Leased Premises is located within a flood hazard zone. Tenant shall provide a copy of the survey to City. Such survey shall contain such other certifications as Tenant or any Provider may request. In the event the survey discloses any matter that is unacceptable to Tenant, Tenant may either waive such matter or may give written notice to City of such unacceptable matter, and City shall have fifteen (15) days in which to cure such matter. In the event City fails to effect such a cure, Tenant may terminate this Lease by written notice to City and obtain a refund of any sums paid as rental to the date of such notice, or Tenant may waive such matter.
