Common use of Boundary Lines Clause in Contracts

Boundary Lines. Except as disclosed in the survey of the Premises and Improvements delivered to Lender in connection with the funding of the Loans (the "SURVEY"), to Borrower's knowledge, (i) all of the Improvements which were included in determining the appraised value of the Trust Property lie wholly within the boundaries and building restriction lines of the Trust Property, (ii) no improvements on adjoining properties encroach upon the Trust Property, and (iii) no easements or other encumbrances upon the Premises encroach upon any of the Improvements, so as to materially and adversely affect the value or marketability of the Trust Property except those which are insured against by title insurance.
