Board Level. In the event that the Union is not satisfied with the disposition of the grievance at the Mediation level, the Union may, in its sole discretion, appeal same to the Board of Education by filing a copy of the written grievance and answer by the Superintendent, along with the reasons for rejecting the Superintendent's disposal of the grievance, with the Secretary of the Board of Education not less than five (5) days prior to the next regularly scheduled board meeting. Upon receipt of the grievance by the Board of Education, the board shall, within one (1) month, schedule a hearing on the grievance with the Board Grievance Committee to hear the grievance. If disciplinary in nature, hearing before the Board Grievance Committee will be closed. Within ten (10) days, the board shall render its written decision concerning the grievance through the Superintendent and transmit it to the Union. The Union shall have the right to have its officers and grievance chairperson or Union's designee present at the hearing along with the grievant. In the event CESPA is not satisfied with the Board's response, it may submit a specific issue of dispute to the board. The Board will have thirty (30) days to respond. If the specific issue is still not resolved, it may be submitted by CESPA for binding arbitration.

Board Level. There shall be established a Committee to be known as the Labor/Management Committee for the State and Community Colleges. The purpose of the Committee shall be to discuss matters of system-wide applicability, which are of mutual concern to the Board and the Union. Each Committee shall be comprised of six (6) members; three (3) representing the Board and three (3) representing the Union. Such representatives shall be appointed respectively by the Vice Chancellor for Employee Relations of the Board and the Union. In addition, the Vice Chancellor for Employee Relations of the Board shall designate the chairperson for management and the Union shall designate the chairperson for the Union. There shall be two meetings per year, unless mutually agreed otherwise, with the position of chairperson alternating between the Board and the Union. Both parties may submit items for the agenda to the chairperson at least two (2) weeks in advance of any scheduled meetings. The agenda shall be distributed one (1) week in advance. It is understood that said Committee shall not discuss pending grievances and shall have no power to negotiate, alter, or amend the terms of this Agreement.

The parties shall be entitled to present witnesses and evidence, and include in the representation such counselors, as they may deem necessary. Board Level. After receiving the decision of the Superintendent, the Aggrieved may choose, within five (5) work days, and prior to submitting the grievance to the OAPSE Grievance Review Committee, to submit the grievance to the Board of Education. At the next meeting of the Board following such submission, the members of the Board and the aggrieved shall meet in Executive Session to openly discuss the matter of the grievance, and any possible resolutions. If no resolution is reached with in five (5) work days of the next Board meeting, the aggrieved may submit the grievance to the OAPSE Grievance Review Committee. Within ten (l0) workdays, the Review Committee shall decide whether to submit the grievance to Level Three.
Board Level. If dissatisfied with the outcome of the previously mentioned stages, any employee or an organization representing the employee may refer the grievance to the Board by arranging through the Superintendent for an appointment with the Board. The Superintendent shall prepare a review of the case for the Board. The Board shall also be given a statement from the aggrieved reviewing previous efforts to resolve the disagreements.
Board Level. If the Association is not satisfied with the disposition of the grievance by the College President, the grievance shall be transmitted to the Board of Trustees. A written Notice of Appeal, setting forth the basis for the appeal, shall be filed with the Board Secretary within fourteen (14) days of receipt of the President's decision. The Board shall hear the grievance at the regular Board of Trustees meeting unless the appeal is filed within seven (7) days of the next regularly scheduled meeting, in which case the grievance shall be heard at the following regularly scheduled meeting. The grievance, together with a record of the prior proceedings, shall be presented to the Board. The Board shall have the option of considering the appeal in an open or closed hearing session. No later than fourteen (14) days after the conclusion of the hearing, the Board shall render its decision in writing to the Association, the grievant, and the President.
