Binding Nature of Arbitration. The arbitration award shall be final and binding on the Parties and shall be immediately enforceable, subject to the remedies provided for in the ICSID Convention and Arbitration Rules or in the Arbitration Rules of the Additional Facility of the Centre, as appropriate. The Parties waive any right to refer any question of law, and any right of appeal on the law and/or merits to any court. It is expressly agreed that the arbitrators shall have no authority to award aggravated, exemplary or punitive damages.

The parties agree to submit to the jurisdiction of any court within the jurisdiction in which the party against whom enforcement is sought has property or assets for purposes of the enforcement of any award, order of judgment.
