BETTER OFF OVERALL. 6.1 Employees covered by this Agreement shall enjoy the terms and conditions of employment which, when taken overall, result in the Employees being better off overall than the terms and conditions of employment that would otherwise apply under the relevant Award.
BETTER OFF OVERALL. The Fair Work Act 2009 (Cth) requires that each of the employees to be covered by the agreement are better off overall than under the relevant modern award. It is the view of the Company and the Union bargaining agent/s that the employees to be covered by this agreement are better off overall than under the Award.
BETTER OFF OVERALL. 1.4.1. The Parties to the Agreement acknowledge that an employee should be better off overall through the making of this Agreement when taken as a total package. The Trust gives the commitment to uphold this principle. 1.4.2. In the event that any provisions or conditions of employment in the Clerks SA Award are reduced or removed, employees to whom this agreement applies, shall not suffer any reduction in wages, entitlements, employment conditions or other benefits.

BETTER OFF OVERALL. In order to ensure that Employees are better off overall, the Employer undertakes that: 15.1 Where an Employee works one or more shifts on a Sunday or a public holiday commencing between 6:00 pm and midnight in a week, or less than 5 consecutive shifts, the Employer will undertake a reconciliation at the end of that week to determine if the Employee’s remuneration received under the Agreement was greater than what the Employee would have received under the Asphalt Industry Award 2020. 15.2 In the event that a reconciliation establishes that an Employee has been paid an amount in a week under the Agreement which is equal or less than what they would have received under the Asphalt Industry Award 2020, the Employer will reimburse the Employee for the difference, plus an additional 1% of the difference. 15.3 Where a shortfall has been established, the Employee will be paid in the period immediately following the reconciliation.

BETTER OFF OVERALL. This Agreement shall be read subject to the NES which shall have effect in accordance with the Act. For the purposes of applying the Better-off Overall test, the parties agree that the Mining Industry Award 2010 as amended as at the time of certification shall apply. The Company acknowledges that there is a dispute as to whether the Employees (or some of them) are eligible to be members of the Coal LSL portable long service scheme. If the dispute is resolved (including on appeal) on a basis that establishes that the Employees are eligible to be members of the scheme, consideration will be given as to whether the Mining Industry Award 2010 or the Black Coal Award 2020 shall apply in future.

  • Rent Rolls; Operating Histories The Seller has obtained a rent roll (the “Certified Rent Roll(s)”) other than with respect to hospitality properties certified by the related Mortgagor or the related guarantor(s) as accurate and complete in all material respects as of a date within 180 days of the date of origination of the related Mortgage Loan. The Seller has obtained operating histories (the “Certified Operating Histories”) with respect to each Mortgaged Property certified by the related Mortgagor or the related guarantor(s) as accurate and complete in all material respects as of a date within 180 days of the date of origination of the related Mortgage Loan. The Certified Operating Histories collectively report on operations for a period equal to (a) at least a continuous three-year period or (b) in the event the Mortgaged Property was owned, operated or constructed by the Mortgagor or an affiliate for less than three years then for such shorter period of time, it being understood that for mortgaged properties acquired with the proceeds of a Mortgage Loan, Certified Operating Histories may not have been available.

  • Agreement Exceptions/Deviations Explanation If the proposing Vendor desires to deviate form the Vendor Agreement language, all such deviations must be listed on this attribute, with complete and detailed conditions and information included. TIPS will consider any deviations in its proposal award decisions, and TIPS reserves the right to accept or reject any proposal based upon any deviations indicated below. In the absence of any deviation entry on this attribute, the proposer assures TIPS of their full compliance with the Vendor Agreement.

  • Operating Plan To Agent and Lenders, as soon as available, but not later than thirty (30) days after the end of each Fiscal Year, an annual combined operating plan (the "Operating Plan") for Parent and its Subsidiaries, approved by the Board of Directors of Parent, for the following Fiscal Year, which (i) includes a statement of all of the material assumptions on which such plan is based, (ii) includes projected monthly income statement, balance sheets and source and use of funds for the following year and (iii) Borrowing Availability projections, all prepared on the same basis and in similar detail as that on which operating results are reported (and in the case of cash flow projections, representing management's good faith estimates of future financial performance based on historical performance), and including plans for personnel, Capital Expenditures and facilities.

  • Construction Cost Budget The total cost to District of all elements of the Project designed or specified by the Architect, as adjusted at the end of each design phase in accordance with this Agreement. The Construction Cost Budget does not include the compensation of the Architect and the Architect’s Consultants, the cost of land, rights-of-way, financing or other costs which are the responsibility of the District, including construction management.

  • Construction, Etc Each covenant contained herein shall be construed (absent express provision to the contrary) as being independent of each other covenant contained herein, so that compliance with any one covenant shall not (absent such an express contrary provision) be deemed to excuse compliance with any other covenant. Where any provision herein refers to action to be taken by any Person, or which such Person is prohibited from taking, such provision shall be applicable whether such action is taken directly or indirectly by such Person. For the avoidance of doubt, all Schedules and Exhibits attached to this Agreement shall be deemed to be a part hereof.
