Common use of Beta Versions Clause in Contracts

Beta Versions. No Warranty – “AS IS” Product If this is a beta or test version, licensee acknowledges that software is prerelease code and is not at the level of performance or compatibility of a final, generally available product offering. Software may not operate correctly and may be substantially modified prior to first commercial shipment or withdrawn. Software is provided “AS IS” without any warranty of any kind. The entire risk arising out of the use or performance of Software remains with Licensee. Licensee acknowledges that operating beta software on a production system may have unintended consequences and has been so advised by Comodo.
