Before or After Substantial Completion. The Design-Builder shall promptly correct Work rejected by the Owner or failing to conform to the requirements of the Design-Build Documents, whether discovered before or after Substantial Completion and whether or not fabricated, installed or completed. Costs of correcting such rejected Work, including additional testing and inspections, the cost of uncovering and replacement, and compensation for any design consultant employed by the Owner whose expenses and compensation were made necessary thereby, shall be at the Design-Builder’s expense.

Roadways, pavements and curbs that are broken, damaged, settled or otherwise defective as a result of receiving, handling, storage of materials or the performance of any Work under the Design- Build Documents shall be fully restored to the satisfaction of the Owner.
Before or After Substantial Completion. 12.2.1.1 The Construction Manager shall promptly correct Work rejected by the Architect, the Development Manager or any governmental authority or failing to conform to the requirements of the Contract Documents, whether discovered before or after Substantial Completion and whether or not fabricated, installed or completed. Costs of correcting such rejected Work, including additional testing and inspections and compensation for the Architect's services and expenses made necessary thereby, shall be at the Construction Manager's sole cost and expense.

Costs of correcting such Work, including additional testing and inspections, the cost of uncovering and replacement, and compensation for the services of any Owner Consultants and expenses made necessary thereby, shall be without change in the Contract Time or Contract Sum (subject to applicable limitations in this Agreement on reimbursement for Cost of the Work) to the extent incurred prior to Final Payment and at the Design-Builder’s expense (not chargeable to the Contract Sum or otherwise reimbursable from Owner) after Final Payment. If prior to the date of Substantial Completion, the Design-Builder, its Architect, a Consultant, a Contractor, or anyone for whom they are responsible uses or damages any portion of the Work, including, without limitation, mechanical, electrical, plumbing and other building systems, machinery, equipment or other mechanical device, the Design-Builder shall cause such item to be restored to "like new" condition at no expense to the Owner.
