The Construction Manager shall include with the GMP proposal a written statement of its basis, which shall include: a list of the drawings and specifications, including all addenda, which were used in preparation of the GMP Proposal; a list of allowances and a statement of their basis; a list of all contingency amounts included in the GMP and a statement of their basis: Any contingency amounts shall be mutually agreed upon and calculated as a percentage of the Fixed Limit Cost of Construction; Each contingency shall be listed as a separate line item within the GMP; Any savings achieved after the bidding and award of Bid Packages shall be applied to the appropriate contingency line item in the GMP; Any application or expenditure of the contingency amounts after the approval of the GMP requires the advance written approval of the Owner; and Any unused contingency amounts remaining at the completion of the Work shall accrue to the Owner in accordance with Section 7.2; a list of the assumptions and clarifications made by the Construction Manager in the preparation of the GMP Proposal to supplement the information contained in the Drawings and Specifications; the date of Substantial Completion upon which the proposed GMP is based, and the Schedule of Work upon which the date of Substantial Completion is based; a schedule of applicable alternate prices; a schedule of applicable unit prices; and

Basis of Guaranteed Maximum Price. The Design-Builder shall include with the GMP Proposal a written statement of its basis, which shall include: GMP Basis Documents which shall include a list of the Drawings and Specifications, including all addenda thereto, and General, Supplementary and other Conditions which were used in preparation of the GMP Proposal and on which the GMP is based. A list of Unit Prices and Allowance Items and a statement of their basis; provided, however, that only such allowances as are agreed to by the Department shall be included. A list of the clarifications and assumptions made by the Design Builder in the preparation of the GMP Proposal to supplement the information contained in the Drawings and Specifications, noting in particular any exclusions. The assumptions and clarifications shall take precedence over the Drawings and Specifications. The Design-Builder shall prepare a separate memorandum that highlights any differences between the then approved drawings and the modifications made in the assumptions and clarifications. Such memorandum shall specifically address any changes in the Project's aesthetics, functionality or performance. The proposed GMP, including a statement of the detailed cost estimate organized by trade categories, allowances, Contingency, and other items and the fee that comprise the GMP. An update to the Project’s schedule to which the Design-Builder will agree to be bound. This update shall be prepared in the same level of detail and in the same manner as the Baseline Schedule. A subcontracting plan setting forth the names and estimated dollar volume of the work that will be perform by local, small, and disadvantaged business enterprises, as certified by the Department of Small and Local Business Development, upon which the GMP is based.
Basis of Guaranteed Maximum Price. A. The CM shall submit to the County a proposed GMP as described herein, and in Exhibit A, and according to the schedule set forth in Exhibit B.
