Background or Criminal History Investigation. Prior to the commencement of any services under this Contract, DCF may request a background or criminal history investigation of any of the Contractor’s employees, contracted personnel, and Sub- contractor’s employees, who will be providing services to DCF under the Contract. If any of the stated personnel providing services to DCF under this Contract is not acceptable to DCF in its sole opinion as a result of the background or criminal history investigation, DCF may either request immediate replacement of the person in question, or immediately terminate this Contract and any related Service Agreement.

The background check will be performed by the DOJ. DOJ holds the right to conduct periodic re-checks of Personnel.

Background or Criminal History Investigation. Contractor shall, as part of its standard hiring practices, have conducted a background check in accordance with Exhibit E on each of its personnel who will perform Services.

Contractor will not engage any person in the performance of Services under this Contract if the results of such persons’ background check do not meet the applicable test criteria, and will remove or reassign any person if it later learns that the person would not qualify if the background test was done. The Contractor will certify on an annual basis that it is in compliance with this requirement and shall provide the State the applicable test criteria it uses for its screening upon request. The Parties acknowledge and agree that any information about the Contracted Personnel and Subcontractor’s employees with respect to background checks, criminal history investigations and related screenings will be deemed to be Personally Identifiable Information which the Contractor cannot disclose. Background or Criminal History Investigation. When the Purchasing Entity business needs require a background or criminal history investigation, and prior to the commencement of any Services under this Participating Addendum, the Purchasing Entity may request that Contractor provide a certification that a background or criminal history investigation of Contractor personnel, and Subcontractor’s employees, who will be providing Services to the Purchasing Entity under the Participating Addendum has been performed on such personnel through either (a) Contractor’s standard pre-employment screening processes or (b) a screening requested by the Purchasing Entity. If any of the stated personnel providing Services to the Purchasing Entity under this Participating Addendum is not acceptable to the Purchasing Entity in its sole opinion as a result of the background or criminal history results, the Purchasing Entity may request immediate replacement of the person. If a replacement is not possible the Participating Entity may terminate any related Purchase Order. Purchasing Entity may not request that Contractor take action because of race, religion, gender, age, disability, or any other legally prohibited basis under federal, state or local law.

If any of the stated personnel providing Services to the State on State premises under this Contract is not acceptable to the State in its sole opinion as a result of the background or criminal history investigation, the State may request prompt replacement of the person.
Background or Criminal History Investigation. The Contractor shall perform no Services under this Contract until the DOJ has completed a fingerprint based background check of all Personnel who will be providing Services to the DOJ under the Contract. DOJ holds the right to conduct periodic re-checks of Personnel. If any of the identified Personnel are not acceptable to the DOJ in its sole opinion, the Contractor shall supply replacement Personnel, subject to the same background checks.
