Award Fee. ‌ Award fees may be applicable to the Contractor’s performance on individual Task Orders. Should an award fee-type Task Order be issued, the total amount of award fee the Contractor may earn over the period of performance will be negotiated before award. The amount of award fee that the Contractor actually earns will be based on an evaluation, as specified in the Task Order, by the Government of the evaluation factors specified in each individual award fee type Task Order. The evaluation of the Contractor’s performance on the Task Order and the determination of Task Order award fees will be accomplished with an Award Fee Plan. The Fee Determination Official (FDO) will unilaterally determine the amount of award fee for performance on individual Task Orders.

Award Fee. The Design-Builder acknowledges and agrees that forty percent (40%) of the Design-Build Fee (the “At Risk Portion”) is at risk, and the Design-Builder shall only be entitled to the At Risk Portion as set forth in Section 7.1.4. Unless and until the Design-Builder’s entitlement to any subset of the At Risk Portion is determined by the Department, the Design-Builder shall only be entitled to xxxx for the portion of the Design-Build Fee that is no at risk. The portion that is not at risk shall be billed in accordance with Article 9.
Award Fee i. The determination of the award fee earned by the Contractor must be in accordance with the Award Fee Evaluation Plan. The award decision will be made for each annual evaluation period pursuant to the procedures in Section G.9 and no interim payments of award fee will be made. Per FAR 16.401(e)(4), unearned award fee cannot rollover from one award fee increment to the next award fee increment.

Award Fee. Award Fee shall be calculated on a cumulative basis including all awarded sums including allocated sums for future years (“Total Award Fee”). It is hereby clear and agreed by all parties that any reduction made to the total awarded sum for reasons that are not within Company’s responsibilities and control will cause the fees owed to FMG to be adjusted to reflect the actual total awarded sum the Award Fee calculation is based on. Award Fee shall be paid via wire transfer as a percentage (per Section 2.3) of any funds available for withdrawal by Company and within 30 days from the date the funds are available for withdrawal and upon presentation of an invoice.
Award Fee. The Government will promptly make payment of any award fee after evaluation at the conclusion of each specified TLIN/OTLIN evaluation period and a determination is made followed by a contractor invoice submission. These determinations will be made on a semi-annual basis. Payment shall be made without the need for a task order modification. Award Fee not earned during the evaluation period shall not be allocated to future evaluation periods.
