Avoidance of Adverse Effects. NSF will make every effort to avoid adverse effects on buildings and structures that contribute to the NRHP-eligible historic district by encouraging any new collaborator(s) to use as many contributing resources as practicable, provided that such use facilitates science- and education-focused operations. If the collaborator(s) does not intend to use a contributing resource and recommends demolition of any such resource, NSF will consider mothballing in accordance with Preservation Brief 31: Mothballing Historic Buildings, issued by the U.S. Department of the Interior, National Park Service (NPS), for possible future use prior to making any decision to demolish a contributing resource. If NSF, after considering mothballing, ultimately decides to demolish a contributing resource, NSF shall follow the requirements set forth in I.B.1. and I.B.3. below. NSF will remain responsible for Section 106 compliance for undertakings involving the buildings and structures as long as it retains ownership of them. USFS will remain responsible for Section 106 compliance for any activity in the future that involves ground disturbance/archaeology.

Avoidance of Adverse Effects. Once the assessment of adverse effects to a historic property has been finalized per Stipulation C, Strata shall notify the NRC within 30 days if it can avoid the historic property that would be adversely affected within the area of ground disturbance activities for each Xxxx Project Phase, including properties of traditional religious and cultural significance to the Tribes. Potential avoidance measures include, but are not limited to, relocating pipelines, roads, facilities, monitoring xxxxx, and other disturbances.

Avoidance of Adverse Effects. The CDF shall ensure that all federally funded projects covered by this PA do not affect or do not adversely affect historic properties. This will be accomplished by identifying and recording historic properties within project APEs, and ensuring that avoidance measures are implemented for any such properties. Avoidance measures may include relocating proposed project activities outside boundaries of identified sites, changing the types of project activities to not affect the identified properties, establishing buffer zones, using a flag-and-avoid program, or implementing other effective, enforceable protection measures designed to ensure that effects or adverse effects to cultural resources do not occur.   • Resolution of Adverse Effects If FEMA determines that an Undertaking may adversely affect a historic property, it shall resolve the effects of the Undertaking in consultation with the SHPO, Grantee(s), subgrantee, participating Tribes the ACHP, if participating, and other consulting parties, by one of the following methods depending upon the severity of the adverse effect(s) as well as determination of the historic property’s significance on a local, state or national level. When FEMA determines an Undertaking will adversely affect an NHL, FEMA shall notify and invite the Secretary and ACHP to participate in consultation in accordance with 36 CFR § 800.10. When the ACHP participates in consultation related to an NHL, the ACHP shall report the outcome of the consultation to the Secretary and the FEMA Administrator.

  • Adverse Operating Effects The NYISO or Connecting Transmission Owner shall notify the Interconnection Customer as soon as practicable if, based on Good Utility Practice, operation of the Small Generating Facility may cause disruption or deterioration of service to other customers served from the same electric system, or if operating the Small Generating Facility could cause damage to the New York State Transmission System, the Distribution System or Affected Systems, or if disconnection is otherwise required under Applicable Reliability Standards or the ISO OATT. Supporting documentation used to reach the decision to disconnect shall be provided to the Interconnection Customer upon request. If, after notice, the Interconnection Customer fails to remedy the adverse operating effect within a reasonable time, the NYISO or Connecting Transmission Owner may disconnect the Small Generating Facility. The NYISO or Connecting Transmission Owner shall provide the Interconnection Customer with five Business Day notice of such disconnection, unless the provisions of article 3.4.1 apply.
