AVERAGE ACTUAL DEFERRAL PERCENTAGE TESTS. For each Plan Year, the Plan shall satisfy one of the following Average Actual Deferral Percentage tests with respect to the Employee Pre-Tax Contributions, and any Qualified Nonelective Contributions and Qualified Matching Contributions treated as Employee Pre-Tax Contributions under Article 5.4, made to the Plan for the Plan Year:
