Availability of Service. We will use reasonable efforts to make the Service available for your use on a continuous basis. The Service may be unavailable for short periods of time for regular or emergency system maintenance. We will endeavor to have our scheduled maintenance occur during non-peak hours. In addition, accessibility to the Service may be interrupted because of conditions beyond our control, including outages in Internet, cellular or other communications availability. We will use diligent efforts to re-establish the Services as promptly as possible. We do not promise the Service will always be available for your use. We may elect to discontinue this Service at any time. If we choose to discontinue the Service, we will provide you with reasonable notice in advance of that fact. We reserve the right at all times to take actions to protect our systems and information, including denial of access to users of the Service.
Availability of Service. 9.1 Subject to the requirements of Applicable Law, Xxxx Atlantic shall be obligated to provide Xxxx Atlantic Services to Reseller under this Agreement only where Xxxx Atlantic is able, without unreasonable expense (as determined by Xxxx Atlantic in its reasonable judgment), (a) to obtain, retain, install and maintain suitable facilities for the provision of such Xxxx Atlantic Services, and (b) to obtain, retain and maintain suitable rights for the provision of such Xxxx Atlantic Services.
Availability of Service. This Distributed Generation Rate (DG-1) (“Rate”) is available to qualifying Member-Consumers (“Participants”) of Distributor’s distribution system (where “Distributor” is a rural electric distribution cooperative served by COOPERATIVE ENERGY, hereinafter “Supplier”). This rate is available where Distributor’s electric distribution facilities of adequate capacity and suitable phase and voltage are adjacent to the premises to be served, and Service is taken according to the Service Policy and Character of Service Available of the Distributor. Where facilities of adequate capacity and suitable phase and voltage are not adjacent to the premises to be served, Distributor may, at its option, require a contribution, higher minimum bill, facilities charge, or other compensation to make Service available. This Rate is available to Participants on a first-come, first-served basis until such time as the installed level of net metered capacity expressed in kW (direct current, or “dc”) exceeds at any time 3 percent of the Distributor’s total system peak demand expressed in kW recorded during the prior calendar year. Note: Generally, unless otherwise specified herein, capitalized terms used throughout this document are as defined in the Distributor’s or Supplier’s Service Policies or in the Mississippi Public Service Commission (“MPSC”) Mississippi Renewable Energy Net Metering Rule and Mississippi Distributed Generator Interconnection Rule.
Availability of Service. The services shall be available on the days and between the hours advised by the Bank to the Customer from time to time. The operation hours may be varied or suspended by the Bank without notice although in all such cases the Bank will endeavour to advise the Customer as soon as reasonably practical by whatever means the Bank deems appropriate. The Date and Time referred to in this agreement/ or on the Internet Site/ or any other document relating to ONE CLICK services shall be the date and the time prevailing in the Republic of Mauritius at the time of the transaction.
Availability of Service. The Customer also acknowledges that the accuracy and timeliness of providing the SMS Alerts Service depends on many factors including the infrastructure and connectivity of the telecom service provider. Furthermore, the Bank does not warrant that any SMS Alerts or part thereof will be free of infection from viruses or other destructive contamination; or that services will remain uninterrupted.
Availability of Service. The Service is available at the rates listed in Sections 4 and 5, through subscription to any of the long distance service offerings available from the Company.
Availability of Service. Neither Us nor the Dealer, Manufacturer, or Retailer shall be liable for any damages whatsoever arising out of delays, either before or after a day or time of service is agreed upon.
Availability of Service. OnLine Banking will be accessible 24 hours a day, seven days a week. OnLine Banking may be inaccessible for a reasonable period for system maintenance. We shall not be liable under this Agreement for failure to provide access. Your access to OnLine Banking shall be determined in the sole discretion of the Bank, subject to applicable law. The Bank reserves the right to modify, suspend or terminate access to OnLine Banking at any time and for any reason without notice or refund of previously incurred fees.
Availability of Service. The Service is available 24 hours a day, seven days a week. The Services may be temporarily unavailable for system maintenance. Services may also be unavailable in the event of an emergency, such as failure of computer or communication equipment. We shall not be liable under this Agreement for the inability to access the Services.
Availability of Service. Provision of service by Operator to Licensee and Permitted End Users at any location is subject to System capabilities and the ability to establish an adequate radio link given topography, terrain, location and other factors to the Permitted End User. Operator shall provide Licensee free of charge with access to Operator's pre-qualification system, if any, applied generally by Operator in the Market Area to confirm service availability. Operator shall confirm service availability to a Permitted End User with such system prior to installation.
