Automatic Amendment. This Agreement shall automatically incorporate any change or modification of applicable state or federal law as of the effective date of the change or modification. The Business Associate agrees to maintain compliance with all changes or modifications to applicable state or federal law.
Automatic Amendment. 33. In the event that bottlers, which purchased for their own account eighty percent (80%) or more of all of the Concentrate for Beverages purchased for the account of all bottlers who are parties to agreements with the Company containing substantially the same terms as this Agreement, agree with the Company to any different provisions to be included in this Agreement, then the Bottler hereby agrees to include an amendment containing such different provisions in this Agreement. The gallons of Concentrate purchased by such bottlers shall be determined based on the most recently-ended calendar year prior to the date such amendment was first offered to bottlers.
Automatic Amendment. Upon the effective date of any amendment to the regulations promulgated by HHS with regard to PHI, this Addendum shall automatically amend so that the obligations imposed on Business Associate remain in compliance with such regulations.
Automatic Amendment. Upon the effective date of any amendment to the regulations promulgated by DHHS with respect to PID, the Agreement shall automatically amend such that the obligations imposed on Vendor as a Vendor remain in compliance with such regulations.
Automatic Amendment. Upon the effective date of any amendment to HIPAA, the Privacy Rule or the Security Rule promulgated by HHS with regard to PHI or ePHI or any other federal or Wisconsin law or regulation impacting the subject matter of this agreement, this Agreement shall automatically amend so that the obligations imposed on Business Associate remain in compliance with such regulations.
Automatic Amendment. This Agreement shall automatically be amended, without further action by any party of any nature, to include any provision in a Future PSA which the particular PSA requires be contained in a subservicing agreement or subservicing arrangement.
Automatic Amendment. Upon the Issuer Trustee ceasing to be the trustee of the Trust, this Indenture, each Related Supplement and each Related Security Document will be automatically amended to delete any reference to the name of the trustee so ceasing to be the trustee of the Trust and to substitute therefor the name of the successor Issuer Trustee or Issuer Trustees as the continuing trustee or trustees of the Trust, as the case may be.
Automatic Amendment. Upon the Trustee ceasing to be a trustee of the Trust, this Agreement will be deemed to be automatically amended to delete any reference to the name of such trustee so ceasing to be a trustee of the Trust and to substitute therefor the name of the successor trustee of the Trust. Notice of any change in the Trustee shall be endorsed upon or attached to this Agreement, signed by the successor Trustee and every such notice shall be sufficient evidence to any Person dealing with the Trustee under this Agreement as to the facts to which it relates.
Automatic Amendment. Upon the effective date of any amendment to the regulations promulgated by the Secretary with regard to PHI, this Exhibit shall automatically amend so that the obligations imposed on NFP remain in compliance with such regulations.
Automatic Amendment. In the event a new Credit Agreement shall be designated by the Borrower consistent with the provisions hereof, the parties hereto agree that, subject to Section 11.1(a)(v), this Agreement may be modified to effect any technical amendments hereto which may be advisable to afford to the lenders and their representatives under such new Credit Agreement the same rights, remedies and protections afforded to the Insurer, the Lenders and their Representatives as of the Closing Date.
