Authority to Transfer. 18.1.1 The District Superintendent shall have authority to transfer members of the bargaining unit. Such transfers shall be made in accordance with the employee's qualifications and the needs and best interest of the District. Transfer of employees from one position to another position not involving a change of salary may be made by the Superintendent at any time.
Authority to Transfer. Should the superintendent determine a need to transfer any teacher to a low-performing school, as defined in this agreement and as provided for in Florida statutes, the process for selection of the affected teacher(s) and any compensation that accrues to such a transferred teacher shall be subject to collective bargaining.

The Community, in its sole discretion, may transfer the Resident from and between Residences, to Nursing Care or Personal Care, or any other appropriate health care facility on a permanent or temporary basis if it determines that such a move should be made because of the health or safety of the Resident or the Community, for the proper operation of the Community, to comply with regulations of the Commonwealth of Pennsylvania, including but not limited to the Pennsylvania Department of Public Welfare, the Pennsylvania Department of Health, local regulations of the Fire Department, the Pennsylvania Department of Insurance, or any other duly constituted authorities or agencies, or to otherwise meet the requirements of law. Upon a determination by the Community’s Appropriate Placement Committee or its successor, that the Resident is no longer capable of meeting the Conditions of Occupancy of the Residence, the Resident or the Resident's legal representative, or agent acting on the Resident's behalf, will be notified by the Community that arrangements will be made for the Resident's transfer to Nursing Care or Personal Care or other appropriate care facility.
Authority to Transfer. 16.101 It shall be the policy of the Board to, if possible, honor an employee's request for transfer of his/her job assignment provided that by so doing, the operations of the District are not made less effective or efficient.
