Authority to Bind Contractor. Upon receipt of a fully executed copy of this Agreement, the Contractor shall furnish to the City a written list of the persons authorized to execute, on behalf of the Contractor, agreements, contracts, modifications to contracts, or other documents as they may be required by the City. In the event authority is delegated to a position (e.g., President, Vice- President, Treasurer) rather than to an individual, the list of positions and individuals filling those positions so authorized shall be furnished. If any changes should occur to this list during the term of this Agreement, a revised copy shall be promptly furnished to the City.

The Collateral Agent shall deliver a copy of each notice referred to in the preceding clause (y) to the relevant Assignor, provided that (x) the failure by the Collateral Agent to so notify such Assignor shall not affect the effectiveness of such notice or the other rights of the Collateral Agent created by this Section 3.3 and (y) no such notice shall be required if an Event of Default of the type described in Section 7.01(i) or (j) of the Indenture has occurred and is continuing.
