Common use of Audits and Inspections Clause in Contracts

Audits and Inspections. Business Associate agrees to make its internal practices, books, and records, including policies and procedures, relating to the use and disclosure of PHI available to the Secretary, in a time and manner mutually agreed to by the Parties or designated by the Secretary, for purposes of the Secretary determining the Covered Entity’s compliance with HIPAA.

Audits and Inspections. Business Associate agrees to shall make its internal practices, books, and records, including policies and procedures, records relating to the use and disclosure of PHI PHI, as defined under this Agreement, available to the Secretary of the United States Department of Health and Human Services (“Secretary”), in a time and manner mutually agreed to by the Parties or designated by the Secretary’s designee, for purposes of the Secretary determining the Covered Contracting Entity’s and Business Associate’s compliance with HIPAAthe applicable laws and regulations. Business Associate shall make its internal practices, books, and records relating to the Use and Disclosure of PHI available to Contracting Entity for purposes of determining Business Associate’s compliance with this Agreement.
