Attainment of age 59½. 2. x Employee pre-tax elective deferrals and the earnings thereon (including any Rxxx 401(k) deferrals, if any). Note: In-service withdrawals of all employee pre-tax elective deferrals and earnings thereon as of December 31, 1988 are permitted only in the event of hardship or attainment of age 59½. In- service withdrawals of earnings after December 31, 1988 are permitted only in the event of attainment of age 59½.
Attainment of age 59½. Upon the election of a Participant who has attained age 59 ½, made pursuant to the written, telephonic or electronic method prescribed by the Committee, the Committee shall direct the Trustee to distribute to the Participant all or any portion of his Account as designated in the request, as soon as practicable after receipt of the request, or at such later time as is specified in the request (subject to the minimum distribution requirements set forth in Section 4.09(b)).

  • In-Service Withdrawals If elected in the Adoption Agreement, an Employer may elect to permit a Participant in the Plan to make an in-service withdrawal, subject to any limitation(s) specified in the Adoption Agreement.

  • Distributions on Account of Separation from Service If and to the extent required to comply with Section 409A, no payment or benefit required to be paid under this Agreement on account of termination of the Executive’s employment shall be made unless and until the Executive incurs a “separation from service” within the meaning of Section 409A.

  • Death Subsequent to Commencement of Benefit Payments In the event the Executive dies while receiving payments, but prior to receiving all payments due and owing hereunder, the Employer shall pay the Beneficiary the same amounts at the same times as the Employer would have paid the Executive, had the Executive survived.

  • Distributions Following Acceleration If the Notes are accelerated after an Event of Default, on each Payment Date starting with the Payment Date relating to the Collection Period in which the Notes are accelerated, the Indenture Trustee will (based on the information in the most recent Monthly Investor Report) withdraw from the Bank Accounts and make deposits and payments, to the extent of funds in the Bank Accounts for the related Collection Period, in the following order of priority (pro rata to the Persons within each priority level based on the amounts due except as stated):

  • Death After Separation from Service But Before Benefit Distributions Commence If the Executive is entitled to benefit distributions under this Agreement, but dies prior to the commencement of said benefit distributions, the Bank shall distribute to the Beneficiary the same benefits that the Executive was entitled to prior to death except that the benefit distributions shall commence within thirty (30) days following receipt by the Bank of the Executive’s death certificate.

  • In-Service Distributions [X] (1) In-service distributions may be made from any of the Participant's vested Accounts, at any time upon or after the occurrence of the following events (select all applicable): [X] (a) a Participant's attainment of age 59-1/2.   • MISSTATEMENT OF AGE OR SEX In the event of a change in the amount of the Ceding Company's liability on a reinsured policy due to a misstatement of age or sex, the Reinsurer's liability will change proportionately. Reinsurance premiums will be adjusted from the inception of the policy, and any difference will be settled without interest.

  • Partial Withdrawals At any time any Holder shall be entitled to request a withdrawal of such portion of the Interest held by such Holder as such Holder shall request.

  • MISSTATEMENT OF AGE If the age of a Member has been misstated, all Premiums payable under this Agreement shall be calculated based on the Premium due based on the Member’s correct age. If the correction of the Member’s age results in an increase in the Premium due, the Subscriber shall pay CareFirst BlueChoice or the Exchange the increased Premium due by the next Premium Due Date after notification by CareFirst BlueChoice or the Exchange. If, due to the correction in the Member’s age, a Subscriber has paid a Premium, or portion of a Premium, not due, CareFirst BlueChoice’s liability is limited to a refund, on request, of any excess Premium paid for the period during which the Member’s age was misstated.
